Pursuant to sections 20 and 50 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule to this notice is acquired for development of public amenity and vested in Ashburton District Council on the date of publication of this notice in the New Zealand Gazette, subject to the reservation in favour of the Crown for railway purposes of the easement set out in the Second Schedule.

Second Schedule
Right of way easement over the land in the Third Schedule (the servient land) as an easement in gross for railway purposes on the terms and conditions set out in the
Seventh Schedule of the Land Transfer Act 1952, subject
to the following:
The formation, maintenance and repair of the right of way shall be at the sole cost of the party having the benefit of the easement.

789 square metres, being part Reserve 1450; shown as "C" on S.O. Plan 19586, lodged in the office of the Chief Surveyor at Christchurch.
