Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for a public work (water works) and is vested in the Manawatu-Wanganui Regional Council together with an appurtenant right of way easement in terms of the Seventh Schedule of the Land Transfer Act 1952 over the land described in the Second Schedule hereto, and such easement to be subject to the additional conditions as set out in the Third Schedule hereto, on the date of publication of this notice in the New Zealand Gazette.

Third Schedule
(a) The council will at its own cost repair any damage to the land, fences, water supply, drainage or other improvements contained in the balance of the land comprised and described in certificate of title 308/175, which has been caused exclusively by the Council while exercising its rights and powers under this easement.
(b) The parties to the easement agree that the right of way over the land described in the Second Schedule hereto shall not be metalled or formed.
