Fisheries (Rapaki Bay Mataitai Reserve Bylaws) Notice 2000 (No. F165)

Pursuant to Regulations 25 and 26 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries hereby gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (Declaration of Rapaki Bay Mataitai Reserve Bylaws) Notice 2000.
(2) This notice shall come into effect 28 days after the date of its notification in the New Zealand Gazette.
2. Interpretation-In this notice:
(a) The term "Rapaki Bay Mataitai Reserve" means the Mataitai reserve at Rapaki Bay, Lyttelton Harbour notified in the Fisheries (Declaration of Mataitai Reserve) Notice 1998 (New Zealand Gazette,
17 December 1998, No. 200, page 4762 ).
(b) Any reference to "Tangata Tiaki/Kaitiaki" means any person or persons appointed as Tangata Tiaki/Kaitiaki for the Rapaki Bay Mataitai Reserve under Regulation 21 of the Fisheries (South Island Customary Fishing) Regulations 1999.
(c) "Rapaki Marae Office" means the Marae Office located at Te Wheke Marae, Rapaki Bay, P.O. Box 107, Lyttelton, Banks Peninsula.
(d) "Cockle" means mollusc Chione (austrovenus) stuchburyi.
(e) "Paua" Haliotis iris, Halitotis australis and Haliotis virginea.
(f) "Pipi" means the mollusc Paphies australis.
(g) "Whairepo" means a skate of the Genus Raja, Bathyraja, or Arhynchabotis or a ray of the Genus Dasyatis, Myliobatis, Mobula, Torpedo, or Typhlonarke.
3. Declaration of bylaws for the Rapaki Bay Mataitai Reserve-The Minister of Fisheries hereby declares the following bylaws for the Mataitai Reserve at Rapaki Bay, Lyttelton Harbour:
(a) All fishing within the Rapaki Bay Mataitai Reserve is to be reported to the Tangata Tiaki/Kaitiaki of the Reserve within five (5) days by filing a catch return form available from the Rapaki Marae Office.
(b) The taking or possession of whairepo (skate and ray) from within the Rapaki Bay Mataitai Reserve is prohibited.
(c) The taking or possession of paua from within the Rapaki Bay Mataitai Reserve is prohibited.
(d) The taking or possession of seaweed within the Rapaki Bay Mataitai Reserve is prohibited.
(e) Bylaw 3 (d) does not apply to the taking or possession of Undaria pinnatifida.
(f) No person shall in any one day take or possess more than 50 cockles from the Rapaki Bay Mataitai Reserve.
(g) No person shall in any one day take or possess more than 50 pipi from the Rapaki Bay Mataitai Reserve.
4. Fishing subject to these bylaws-Under Regulations 25 (3) and 43 of the Fisheries (South Island Customary Fishing) Regulations 1999, all fishing within the Rapaki Bay Mataitai Reserve is subject to these bylaws.
5. Revocation-The Fisheries (Rapaki Bay Mataitai Reserve Bylaws) Notice 1999 (No. F125) published in the New Zealand Gazette, 12 August 1999, No. 94, page 2248 is hereby revoked.
