Constitution Notice For Council of the Open Polytechnic of New Zealand

Pursuant to section 170 of the Education Act 1989, the Minister of Education gives the following notice:
N o t i c e
1. This notice may be cited as the Constitution of the Council of The Open Polytechnic of New Zealand Notice 2000.
2. This notice shall come into force on the day after the date of its publication in the New Zealand Gazette.
3. The Council of The Open Polytechnic of New Zealand shall be constituted as follows:
(a) Four members appointed by the Minister of Education.
(b) The chief executive officer of The Open Polytechnic of New Zealand.
(c) One permanent member of the academic staff of The Open Polytechnic of New Zealand elected by the permanent members of that staff.
(d) One permanent member of the general staff of The Open Polytechnic of New Zealand elected by the permanent members of that staff.
(e) One member (who is a co-opted member under paragraph (h) of this clause) who is, or has been, a student of The Open Polytechnic of New Zealand within 3 years of first appointment to Council (and who is not an employee of the Open Polytechnic of New Zealand), who shall be appointed by The Open Polytechnic of New Zealand Council after public advertising and selection in a manner as is provided by statutes made by the Council.
(f) One member appointed by The Open Polytechnic of New Zealand Council after consultation with the New Zealand Employers' Federation Incorporated.
(g) One member appointed by The Open Polytechnic of New Zealand Council after consultation with the New Zealand Council of Trade Unions.
(h) At least 3 and not more than 6 members (including the student representative appointed under paragraph (e) of this clause) co-opted by The Open Polytechnic of New Zealand Council (and who are not employees of The Open Polytechnic of New Zealand) to ensure specified requirements for competencies, perspectives and expertise are covered on the Council.
4. Subject to section 173 of the Education Act 1989, the maximum term of office of members appointed to the Council, other than the chief executive officer, is
3 consecutive 4 year terms.
5. The member of the Council appointed under clause 3 (e) shall be appointed for an initial term of 2 years commencing from the date of the first council meeting that member attends, and for a maximum of 3 consecutive 2-year terms.
6. The Amendment to Constitution of Council of The Open Polytechnic Notice 1997 appearing in the New Zealand Gazette, 3 July 1997, No. 66, pages 1562 and 1563 is hereby revoked.
