In the matter of certain charitable trusts declared by the will of Helena Edith Evans, late of Christchurch, widow deceased, who died on 28 January 1998 leaving a will dated 5 August 1988, Probate whereof was granted out of the High Court at Christchurch on 20 March 1998 to the Public Trustee of New Zealand, the sole executor and trustee named therein:
Notice is hereby given, pursuant to section 36 of the Charitable Trusts Act 1957, that the Public Trustee has applied to the High Court of New Zealand at Christchurch for approval of a scheme in respect of certain charitable trusts declared by the will of the late Helena Edith Evans, aforesaid.
The said will, by clause 4.2, thereof disposed of the whole of her estate, after payment of her debts, funeral expenses, trustee's administration expenses and any death duty payable on her estate, as follows:
"To transfer the residue to the Canterbury Hospital Board for the purposes of the Coronation Hospital, Christchurch. A receipt appearing to my trustee to be given on behalf of the hospital will be a complete discharge to my trustee for the gift."
The Canterbury Hospital Board ceased to exist on 1 June 1989; Coronation Hospital closed in December 1991.
An order will be sought from the High Court aforesaid to approve a scheme as follows:
"That in lieu of the trusts relating to the disposition of the residue of the estate of the late Helena Edith Evans, as expressed in clause 4.2 of her will dated 5 August 1988, the residue of her estate now be disposed of to:
"Healthlink South for the charitable purposes of the health care of the elderly including the 'Older Persons' Health Services', at Christchurch, administered by the Princess Margaret Hospital.
A receipt appearing to the Public Trustee to be given on behalf of Healthlink South shall be a complete discharge to the Public Trustee for this gift."
The application by the Public Trustee for approval of the said scheme will be heard in the High Court at Christchurch at 10.00 a.m. on Wednesday, the 5th day of April 2000.
A copy of the said scheme has been deposited, and may be inspected at the Registry of the High Court at Christchurch under M. No. 555/99, or at the offices of the Public Trust Office, 152-156 Oxford Terrace, Christchurch.
Any person desiring to oppose the scheme is required to give written notice of an intention to do so to the Registrar of the said High Court, and to the Public Trustee of New Zealand, and to the Attorney-General no less than 7 clear days before the date of hearing aforesaid.
