Notice of Application to Vary a Charitable Trust

In the matter of the Charitable Trusts Act 1957, and in the matter of the McElroy Trust, of P.O. Box 134, Auckland, a charitable trust:
Take notice that on the 5th day of July 2000, an application for variation of the McElroy Trust ("the trust") by scheme of arrangement was filed with the High Court at Auckland.
The scheme proposes that the assets of the trust be resettled as to:
(a) 75% by value on the trustees of a new trust to be called the McElroy 1999 Trust; and
(b) 25% by value on the trustees of a new trust to be called the McElroy Anglican Trust.
The application is to be heard before the High Court at Auckland on the 4th day of September 2000 at 10.00 a.m.
Any person desiring to oppose the scheme must give written notice of his intention to do so to:
1. The Registrar of the High Court at Auckland; and
2. The trustees of the McElroy Trust; and
3. The Attorney-General
not less than 7 clear days before the 4th day of September 2000.
