Approval for Motor Homes and Rubbish Collection Vehicles to Have Greater Rear Overhang

Pursuant to Regulation 49 of the Traffic Regulations 1976, and by way of a delegation from the Director of Land Transport Safety dated 3 May 1999, I, Donald Norman Hutchinson, Senior Engineer, Safer Roads, hereby approve the operation of mobile homes and rubbish collection vehicles as defined in the First Schedule of this notice contrary to the provisions of Regulations 48B (1) (e) and 48B (1) (f), but subject to compliance with the conditions set out in the Second Schedule.
This notice comes into force on the date of its publication in the New Zealand Gazette.
First Schedule
Definition
A mobile home is a rigid heavy motor vehicle which can be used as a place of abode and contains facilities for cooking, eating, sleeping and washing, and is not a passenger service vehicle.
A rubbish collection vehicle is a rigid heavy motor vehicle which is principally used for the collection of refuse and solid waste material and includes a vehicle with a rubbish compactor.
Second Schedule
Operating Conditions
1. The rear overhang must not exceed the lesser of
4.0 metres or 70 percent of the distance from the rear axis to the foremost axle of the vehicle.
2. The weight on the front axle set or twin steer set of the vehicle must at all times be at least 20 percent of sum of the axle weights of the vehicle.
3. If the vehicle has a tow coupling which is rated to tow a heavy trailer, the position of the tow coupling must not be further rearward of the rear axis of the vehicle than a measurement which is not more than 50 percent of the distance from the foremost axle to the rear axis of the vehicle.

Explanatory Note:
This notice allows mobile homes and rubbish collection vehicles to have extended rear overhang. Note that an operator who breaches any of the conditions in the Second Schedule loses entitlement to the extended rear overhang exemption. Consequently, a police officer may remove the vehicle from service until it does comply with the conditions in the Second Schedule and may issue an offence notice for exceeding Traffic Regulations 48B (1) (e) or 48B (1) (f).
