Declaration Under the Submarine Cables and Pipelines Protection Act 1996

Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Maritime Safety Authority by an Instrument of Delegation dated 19 March 1997.
And whereas, pursuant to section 442 of the Maritime Transport Act 1994, the Maritime Safety Authority did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Director of Maritime Safety by an Instrument of Delegation dated
26 March 1997.
And whereas, pursuant to section 443 of the Maritime Transport Act 1994, the Director of Maritime Safety did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to me by an Instrument of Delegation dated 26 March 1997.
Therefore I, John Norman Keith Mansell, Divisional Manager, Maritime Operations, hereby make the following declaration:
D e c l a r a t i o n
The Order in Council under section 12 of the Submarine Cables and Pipelines Protection Act 1996, entitled the Submarine Cables and Pipelines Protection Order 1992, shall not apply in respect of the following ship:
Lady Jess
and R.I.B.s and small craft associated with that ship whilst working in the protected area designated "Area 2-Hauraki Gulf" for the purpose of an R.O.V. inspection of the shipwreck R.M.S. Niagara and with the conditional written approval of Telecom New Zealand Limited, for the period from 25 to 30 January 2000.
This notice comes into effect on and from the 20th day of January 2000.
