Radiocommunications (Radio) Regulations (General Licence for 406 MHz Emergency Position Indicating Radio Beacons) Notice 1999 Pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, and acting under delegated authority from the Secretary of Commerce, I give the following notice: N o t i c e 1. Short title and commencement (1) This notice may be cited as the Radiocommunications (Radio) Regulations (General Licence for 406 MHz Emergency Position Indicating Radio Beacons) Notice 1999. (2) This notice comes into force on 4 February 1999. 2. General licence A licence under regulation 13 of the Radiocommunications (Radio) Regulations 1993 is granted for the installation, operation, and use of emergency position indicating radio beacons on any New Zealand ship and any aircraft registered in New Zealand for the transmission of radio distress alerts for the purpose of determining both the location and identity of persons, vessels, or aircraft in distress in conjunction with the COSPAS-SARSAT system. 3. Terms, conditions and restrictions (1) This licence applies only to apparatus which complies with Australian/New Zealand Standard AS/NZS 4280:1995 and in respect of which a declaration of conformity has been submitted to the Secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993. (2) The frequencies available for use under this licence are those specified in the First Schedule to this notice. (3) The technical conditions applying under this licence are those specified in the Second Schedule to this notice. (4) Where any radio apparatus to which this licence applies ceases to be used or installed that radio apparatus must be rendered inoperable to avoid the inappropriate transmission of distress signals. (5) Where any radio apparatus to which this licence applies is transferred to a new owner, the new owner must provide the Maritime Safety Authority with a new owner registration card. 4. Period of validity of licence This licence expires on 31 January 2004. Explanatory Note This note is not part of the notice, but is intended to indicate its general effect. This notice prescribes that, pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, a general licence is granted in respect of the installation, operation, and use of radio apparatus on frequencies specified in this notice. The licence only applies to radio apparatus which complies with the standard AS/NZS 4280:1995, and that is installed, operated and used for the transmission of radio distress alerts on New Zealand registered vessels and aircraft in conjunction with the COSPAS-SARSAT system. This notice comes into effect on 4 February 1999.
