Radiocommunications (Radio) Regulations (Supply of Transmitting Apparatus Exemption From the Need to Submit Returns on Specific Categories of Apparatus) Notice 1999 Pursuant to regulation 26 (a) of the Radiocommunications (Radio) Regulations 1993 (``the Regulations''), and acting under delegated authority from the Secretary of Commerce, I give the following notice: N o t i c e 1. Short title and commencement (1) This notice may be cited as the Radiocommunications (Radio) Regulations (Supply of Transmitting Apparatus Exemption From the Need to Submit Returns on Specific Categories of Apparatus) Notice 1999. (2) This notice comes into force on the 26th day of August 1999. 2. Returns in respect of transmitting apparatus (1) In accordance with regulation 26 (a) of the regulations, holders of a licence issued under regulation 19 of the regulations are not required to supply returns for the following types of apparatus: (a) Cellular telephones that are capable of being connected to cellular telephone networks. (b) Mobile two frequency (semi-duplex) transmitters that are able to be used in the Land Mobile Radio Service, where no simplex frequencies are fitted. (c) Transmitting equipment that meets the requirements of Radio Frequency Specification RFS 29 - Restricted Radiation Devices, and is able to be operated under the terms of the General Licence in force for such equipment. (d) Mobile transmitters used in the Personal Radio Service (PRS) that are able to be operated under the terms of the General Licence in force for such equipment. (e) Transmitters used in the Citizen Radio Service that are able to be operated under the terms of the General Licence in force for such equipment. (f) Emergency Position Indicating Radio Beacons, Personal Locator Beacons and Aeronautical Locator Beacons (EPIRBs, PLBs, ALBs) that are able to be operated under the terms of the General Licence in force for such equipment. 3. Explanatory Note This note is not part of the notice, but is intended to indicate its general effect. This notice provides that any person licensed under regulation 19 of the Radiocommunication (Radio) Regulations 1993, to supply radio apparatus, will no longer be required to file returns, required under regulation 26, for the equipment types named in this notice.
