Notice of Intention to Declare a Major Maritime Event Pursuant to section 200a (3) (d) of the Maritime Transport Act 1994, I give notice that I have received from the Auckland Regional Council an application to declare the America's Cup Regatta to be an event to which section 200b of the Maritime Transport Act 1994 applies for the period 19 February 2000 to 9 March 2000 inclusive; and that I intend to make a declaration to that effect by notice in the Gazette. Areas Affected by the Application The areas in respect of which the application is made are defined as follows: America's Cup Village area, being all those waters lying to the south of a line joining the northern most ends of Wynyard Wharf and Princes Wharf; Inner Harbour West area, being all those waters lying to the east of the Auckland Harbour Bridge and to the west of a line drawn between Point Resolution and the south eastern end of Devonport Wharf; Inner Harbour East area, being all those waters bounded to the west by a line drawn between Point Resolution and the south eastern end of Devonport Wharf, to the east by Bean Rocks Lighthouse and number 6 and number 9 buoys, and to the north by a line between number 4 and number 3 buoys, Rough Rock buoy and Takapuna head; Race Track area, being all those waters bounded to the south by latitude 36 46.7 S, to the west by the coastline of the North Shore, to the north by the coastline of the Whangaparaoa Peninsula extended to the southern tip of Tiri Tiri Matangi Island and thence to Shearer Rock, to the east by a line drawn from Shearer Rock to the northern tip of Rakino Island and thence by a line from the northern tip of Rakino Island to Billy Goat Point and along the shoreline of Mototapu and Rangitoto Islands to join with latitude 36 46.7 S. Proposed Rules It is intended that the following rules will apply to the areas described above: America's Cup Village area 1. All vessels limited to a maximum speed of 5 knots; 2. No vessel to approach within 100 metres of vessels transferring fuels or chemicals at Wynyard Wharf; and 3. All vessels to obtain clearance from Viaduct Control on VHF Channel 73 before entering the area or leaving any berth in the area. Inner Harbour West 1. All vessels, excluding those used in registered ferry operations, limited to a maximum speed of 5 knots. Inner Harbour East 1. All vessels, excluding those used in registered ferry operations, or those using the high speed lane at the southern and eastern boundaries of the area, limited to a maximum speed of 10 knots; and 2. The commercial shipping channel reserved for use by (a) Commercial shipping operations controlled by the Ports of Auckland; and (b) Vessels specifically authorised by the Harbourmaster to use that channel. Race Track Areas Within this area, race courses will be established from day to day and will be publicly announced. Outside the race courses, normal navigation will be permitted. Inside the race courses, it is intended that the following rules will apply: 1. Only competing yachts, associated tenders, and vessels used by umpires and marshals will be permitted to navigate within the race courses throughout the period of racing operations for the day, provided that the event organiser may accredit various other vessels and allow them to navigate within the race courses; 2. All vessels to be navigated in accordance with Maritime Rules, Part 22 Collision Prevention. Hours of Operation For all areas, except the America's Cup Village area The rules specified for these areas will apply generally from 0800 to 1600 hours but will be subject to change and determined on a daily basis. The specific hours of operation will be announced on public broadcasting and marine communication channels. For the America's Cup Village area The rules specified for this area will apply 24 hours a day for the entire period covered by the proposed declaration. The Auckland Regional Council will retain the power to order the abandonment of racing if, in the opinion of the Council's Harbourmaster, adequate levels of public safety cannot be guaranteed. This power will be exercised in consultation with the New Zealand Police, the Event Organiser, and Ports of Auckland Limited. On race days, the co-ordination and management of commercial shipping in Waitemata Harbour will be conducted jointly by the Auckland Regional Council's Harbourmaster and the Marine Services Manager, Ports of Auckland Limited. Any person or organisation may forward written comments on this proposal to Roger Brown Ministry of Transport P.O. Box 3175 WELLINGTON provided any such comments are received at the above address no later than 5 p.m. on 12 August 1999. Comments are submitted on the presumption that they will be made public.
