Radiocommunications (Radio) Regulations (General Licence for Personal Handy Phone System, Number 2) Notice 1999 Pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993 (``the regulations''), and acting under delegated authority from the Secretary of Commerce, I hereby give the following notice: N o t i c e 1. Short title and commencement (1) This notice may be cited as the Radiocommunications (Radio) Regulations (General Licence for Personal Handy Phone System, Number 2) Notice 1999. (2) This notice comes into force on 1 March 1999. 2. Interpretation For the purposes of this notice: (a) ``Wireless local loop system'' means a telecommunications system which provides wireless access between a network and a handset or terminal or data terminal where the handset or terminal or data terminal is situated within private premises. (b) ``Public service'' means a system which enables a subscriber to use a handset or terminal or data terminal to access a network and to transmit or receive telephone calls in public places. (c) ``Home cordless apparatus'' means any radio apparatus designed to provide a wireless extension within private premises to a handset or terminal or data terminal, but does not include a wireless PABX. (d) ``Wireless PABX apparatus'' means any radio apparatus designed to provide a wireless extension to PABX equipment where that PABX equipment is situated within private premises. (e) ``Network'' has the meaning given to that term by section 2 of the Telecommunications Act 1987. 3. General licence A general licence under regulation 13 of the Radiocommunications (Radio) Regulations 1993 is hereby granted for the installation, operation, and use by persons in New Zealand of radio apparatus known as the Personal Handy Phone System (PHS) intended for radiocommunications within New Zealand, in accordance with the terms of this notice. 4. Terms, conditions and restrictions (1) The range of frequencies available for use under this licence are 1895 MHz to 1920 MHz. (2) This licence applies only to radio apparatus that complies with the Association of Radio Industries and Businesses (ARIB) Standard, Version 2, RCR STD-28 and subsequent amendments and in respect of which a declaration of conformity has been submitted to the secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993. (3) Installation, operation, and use of wireless PABX apparatus, wireless local loop systems and home cordless apparatus is permitted. (4) Installation, operation, and use of a public service is not permitted. (5) Frequency use is on a shared basis and the secretary does not accept any liability under any circumstances for any loss or damage of any kind occasioned by the unavailability of frequencies or interference to reception. Should interference occur the secretary reserves the right to require that any radio apparatus licensed herein cease operation. (6) Power output is limited to 160 mW Pk equivalent isotropically radiated power. 5. Period of validity of licence Unless terminated earlier, pursuant to regulation 13 (2) of the regulations, this licence expires on 31 January 2004. Dated at Wellington this 23rd day of February 1999. This notice prescribes that, pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, a general licence is granted in respect of the installation, operation, and use of radio apparatus on frequencies specified in this notice. The licence only applies to radio apparatus which complies with technical specification ARIB Standard, Version 2, RCR STD-28 and subsequent amendments and in respect of which a declaration of conformity has been submitted to the secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993. This notice comes into effect on 1 March 1999.
