Summary of Exemptions Granted by the Director of Civil Aviation Pursuant to section 37 of the Civil Aviation Act 1990, notification is hereby given of summaries of exemptions as set out in the Schedule hereto, granted by the Director of Civil Aviation. Schedule Director's Action on External Petitions for Exemptions 98/EXE/57 On 23 September 1999. To Alpine Fighter Collection (AFC). From the requirement in Civil Aviation Rule 47.101 (a) that the aircraft bear a registration mark in the manner, and in accordance with, the specifications prescribed in 47.109 to 47.119 inclusive. The exemption allows the Hawker Hurricane MKIIA aircraft, serial number P335, registration ZK-TPK, to display historical scheme of the aircraft as operated by 73 Squadron, June 1940. 99/EXE/57 On 17 September 1999. To Air New Zealand Limited. From the requirement of Civil Aviation Rule 121.571 that each holder of an air operator certificate shall ensure, after each crew member completes a transition segment of its training programme, the crew member undergoes consolidation by acquiring the appropriate line-operating flight time for a pilot. 99/EXE/80 On 17 September 1999. To each person operating an aircraft that has a passenger seating configuration, excluding any flight crew seat, of not more than 19 seats. From the requirement in Civil Aviation Rule 91.115 (a) (1) that at least one flight attendant is carried, provided that the only passengers being carried in excess of 19 are children less than 4 years of age who are carried in accordance with CAR 91.207 (c) (1) and the total number of passengers does not exceed 24. This exemption shall apply until 1st day of April 2000 or until withdrawn in writing by the Director to Civil Aviation Authority of New Zealand. 99/EXE/85 On 20 September 1999. To Ultra Helicopters Inc. (NZ) Limited. From the requirement in Civil Aviation Rule 47.101 (a) that each holder of a New Zealand certificate of registration shall ensure that the aircraft bears a nationality and registration mark in accordance with the specification in Civil Aviation Rule 47.117 (d) (1) provided that the height of markings on the aircraft, bearing both nationality and registration marks on the bottom surface of the fuselage or cabin, is not less than 250 mm high. This exemption is granted only in respect of American Sportscopter 600 aircraft, registrations ZK-HJX; ZK-HJI; ZK-HJU; ZK-HJP. 99/EXE/90 On 23 September 1999. To Helicopters (NZ) Limited. From the requirement in Civil Aviation Rule 47.101 (a), that the holder of a certificate of registration shall ensure that the aircraft bears a nationality and a registration mark in accordance with the specification in Civil Aviation Rule 47.117 (d) (1) provided that the height of both the nationality and the registration mark on the bottom surface of the fuselage or cabin is not less than 250 mm. The exemption applies to 26 of the rotorcraft fleet operated by Helicopters (NZ) Limited displaying both nationality and registration marks. 99/EXE/92 On 13 September 1999. To Tourism Holdings Limited being the holder of an air operator certificate issued under Part 119, and operating a Porter type aircraft onto the South Island glaciers. From the requirement of Civil Aviation Rule 125.307 (a) to ensure that a load manifest has been completed prior to each air operation. Only in respect of VFR sight seeing operations using a Pilatus PC-6/B2-H4 Turbo Porter type aircraft, that depart from and remain within 25 mm of, and return to, the same aerodrome, with only one intermediate landing at a site away from the aerodrome of departure. 0/EXE/17 (1) On 20 September 1999. To 23 Air Traffic Controllers of the Auckland Oceanic Sector, Airways Corporation of NZ Limited. From the requirement in Civil Aviation Rule 65.303 (a) (3) (ii) to allow the assessment and issue of `first of type' Area Control Automatic Dependant Surveillance ratings. 0/EXE/17 (2) On 20 September 1999. To William Thomas Appleby, Controller of the Auckland Oceanic Sector, Airways Corporation of NZ Limited. From the requirement in Civil Aviation Rule 65.405 (b) (1) to hold a current rating and validation for the relevant service, namely an ADS rating. The exemption allows William Thomas Appleby to exercise the privileges of an instructor rating under CAR 65.405 (a) for the assessment of an air traffic controller in a non-operational environment under CAR 65.303 (a) (5) and provide for the issue of an air traffic controller ADS rating under CAR 65.305 (a). 0/EXE/17 (3) On 20 September 1999. To William Thomas Appleby, Controller of the Auckland Oceanic Sector, Airways Corporation of NZ Limited. From the requirement in Civil Aviation Rule 65.455 (b) (1) to hold a rating for the relevant service, namely an ADS rating. The exemption allows William Thomas Appleby the privileges of an examiner rating under 65.455 (a), for the purpose of conducting written, oral and practical tests for the issue or continued currency of air traffic service licences, or the issue or continued currency of air traffic service instructor ratings. 0/EXE/18 On 23 September 1999. To DAC Aviation Limited, being the holder of the certificate of registration. From the requirement in Civil Aviation Rule 47.101 (a) that the aircraft bear a registration mark in the manner, and in accordance with, the specifications prescribed in 47.109 to 47.119 inclusive, in respect of De Havilland DH82A Tiger Moth aircraft, registration ZK-BJR. 0/EXE/25 On 30 September 1999. To Air New Zealand Limited for specified Boeing 737-300 type aircraft. From the requirement that (with exceptions not applicable in this case), each aircraft shall have an automatic ELT installed that meets the specifications as prescribed in Civil Aviation Rule 91 Appendix A, paragraph A.15. 0/EXE/26 On 23 September 1999. To Heritage Helicopters. From the requirement that aircraft bear a registration mark in the manner, and in accordance with, the specifications prescribed in 47.109 to 47.119 inclusive, in respect of Dauphin AS365 C1 aircraft, serial number 5031, registration ZK-HPR, This exemption shall remain in effect from 1 October until 30 November 1999 or until withdrawn in writing by the director. 0/EXE/28 On 30 September 1999. To Air New Zealand Limited (Engineering Services Auckland). From the requirements of Civil Aviation Rule 91.501 (2) and 91.525 that (with exceptions not applicable in this case) each aircraft shall have an automatic ELT installed for Boeing 747 and Boeing 767 type aircraft operated by Air New Zealand. This exemption shall apply until 31 December 2000 or until withdrawn in writing by the director.
