Exemption From Specified Lighting Requirements of the Traffic Regulations 1976 and the Transport (Vehicle Standards) Regulations 1990 Pursuant to regulation 90 (1) of the Traffic Regulations 1976 `TR76' and pursuant to regulation 36 of the Transport (Vehicle Standards) Regulations 1990 `VSR90', I, Simon Christopher Whiteley, Manager Safer Vehicles Policy, hereby exempt motor vehicles of all Classes of Groups L, M and N fitted with auxiliary headlamps (including front fog lamps) from the requirements listed in Schedule 1 of this notice, subject to the conditions specified in Schedule 2. The exemption notice published in the New Zealand Gazette, No. 49, page 1130 of 15 May 1997, entitled `Exemption of Certain Motor Vehicles From Requirements of the Traffic Regulations 1976 Relating to Auxiliary Headlamps' and referenced `au3110', is hereby revoked. Schedule 1 Exempted requirements TR76: Regulation 65 (a) VSR90: Regulation 23 (1) Regulation 24 Schedule 2 Conditions (i) This exemption applies to vehicles with headlamps as specified by regulation 58 (1) (a) of the TR76 `single headlamps'; (ii) This exemption also applies to vehicles with dual headlamp systems as specified by regulation 58 (1) (b) of the TR76, but only if any such dual headlamp system is the vehicle manufacturer's original equipment specification, and only if any such dual headlamp system comprises no more than two main beam headlamps; A pair of auxiliary headlamps (including front fog lamps) fitted to a vehicle with single headlamps does not make the vehicle a vehicle with a dual headlamp system for the purpose of this notice, even if the auxiliary headlamps (including front fog lamps) were fitted by the vehicle manufacturer as original equipment. (iii) One pair, and only one pair, of auxiliary headlamps (other than front fog lamps) may be fitted to a vehicle, whether as original equipment or after market, providing the lamps comply with one of the standards approved for headlamps under Item 5 of the Second Schedule of the VSR90, and providing the lamps are electrically connected so that they cannot be operated when the vehicle's original equipment headlamps are switched on low beam; For Group L vehicles, the fitting of only one auxiliary headlamp (other than a front fog lamp) is also permitted. Auxiliary headlamps (other than front fog lamps) fitted to Class MA or NA vehicles first registered in New Zealand before 1 January 1992, or fitted to vehicles of other Classes of Groups M and N first registered in New Zealand before 1 January 1996, or fitted to any Group L vehicles, are not required to meet approved standards providing the lamps are fitted with globes that do not exceed 55 watt. (iv) One pair, and only one pair, of front fog lamps may be fitted to a vehicle, whether as original equipment or after market, providing the lamps comply with one of the standards approved for fog lamps under Item 13 of the Second Schedule of the VSR90, and providing the lamps are mounted in a permanently dipped position; For Group L vehicles, the fitting of only one front fog lamp is also permitted. Front fog lamps fitted to vehicles first registered in New Zealand before 1 January 1996, or fitted to any Group L vehicles, are not required to meet approved standards providing the lamps are fitted with globes that do not exceed 55 Watt. Note: Under the TR76, a fog lamp is interpreted as a lamp providing illumination in conditions of fog, snow, cloud, or other atmospheric conditions which reduce visibility. (v) Any auxiliary headlamps (including front fog lamps) permitted by this exemption, whether fitted as original equipment or after market, must be securely and rigidly mounted, and must not emit light other than one that is substantially white or amber in colour.
