Land Acquired for Waterworks in Masterton District Upper Plain Road Pursuant to sections 17 and 20 of the Public Works Act 1981, and by a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, hereby declares the land in the First Schedule to this notice, and the riparian rights (ad medium filum acquae) of the adjoining owner of the land described in the Second Schedule, to be taken, an agreement to that effect having been entered into for (a) Waterworks for the purposes of water supply and vested in The Masterton District Council from the date of publications of this notice in the New Zealand Gazette, and together with; (b) An easement in gross to convey water as defined in the Seventh Schedule of the Land Transfer Act 1952 over areas K, A, and B described in the Third Schedule, and together with, (c) An easement in gross of right of way, as defined in the Seventh Schedule of the Land Transfer Act 1952 over areas K, A, and B described in the Third Schedule, subject to and together with the rights implied for vehicular access by the Ninth Schedule of the Property Law Act 1952 (d) An easement in gross of right of way, as defined in the Seventh Schedule of the Land Transfer Act 1952 subject to and together with the rights implied for vehicular access by the Ninth Schedule of the Property Law Act 1952 over area C described in the Fourth Schedule.
