Right of Way Easement Acquired at Te Waka Microwave Site Hastings District Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Property Officer, Land Information New Zealand, Wellington, declares that, an agreement to that effect having been entered into, the easement described in the Second Schedule hereto, is acquired as an easement in gross over those parts of the land described in the First Schedule as are specified in the Second Schedule and shall vest in the Crown (``the grantee'') for post office purposes (access to telecommunications site) on the date of publication in the New Zealand Gazette. Such easement may be surrendered at any time by a further notice in the New Zealand Gazette. Hawke's Bay Land District First Schedule 1. An estate in fee simple for 122.6500 hectares, being Sections 23 and 24, Block XVI, Pohue Survey District, comprised in certificate of title K2/1005. 2. An estate in fee simple for 280.2129 hectares, being part Section 9, Block XVI, Pohue Survey District, comprised in certificate of title B3/400. 3. An estate in fee simple for 101.4400 hectares, being Section 11, Block XVI, Pohue Survey District, comprised in certificate of title K2/1006. 4. An estate in fee simple for 117.3082 hectares, being Section 10, Block XVI, Pohue Survey District, comprised in certificate of title L2/1117. 5. An estate in fee simple for 23.9744 hectares, Block XIII, Maungaharuru Survey District, being part Lot 1, Deeds Plan 487, being portion of Block 97, Patoka Crown Grant District, comprised in certificate of title F3/67. 6. An estate in fee simple for 12.0897 hectares, being part Rural Section 1, Pohue Bush, Block XIII, Maungaharuru Survey District, comprised in certificate of title F3/68. Part Lot 1, Deeds Plan 487, Block XIII, Maungaharuru Survey District; marked ``F'' on S.O. 10789. 7. Part Rural Section 1, Pohue Bush, Block XIII, Maungaharuru Survey District; marked ``G'' on S.O. 10789. S.O. Plan 10789 is held in the office of the Chief Surveyor at Napier. Additional Rights and Conditions Included in the Easement 1. The rights and powers implied in easements of right of way, pursuant to the Ninth Schedule to the Property Law Act 1952, and the Seventh Schedule to the Land Transfer Act 1952, shall apply to the easement referred to herein as modified by the conditions contained herein. 2. The grantee shall compensate the owner for any proved loss or damage caused by the use of such right of way. 3. The right of way shall follow a route to be agreed upon between the grantee and the owner and shall be maintained by the grantee to an all-weather standard at its own expense. 4.
