Declaration Under the Submarine Cables and Pipelines Protection Act 1996 Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate the power under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Maritime Safety Authority by an Instrument of Delegation dated 19 March 1997. And whereas, pursuant to section 442 of the Maritime Transport Act 1994, the Maritime Safety Authority did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Director of Maritime Safety by an Instrument of Delegation dated 26 March 1997. And whereas, pursuant to section 443 of the Maritime Transport Act 1994 the Director of Maritime Safety did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to me by an Instrument of Delegation dated 26 March 1997. Therefore I, John Norman Keith Mansell, Divisional Manager, Maritime Operations, hereby revoke the Declaration under the Submarine Cables and Pipelines Protection Act 1996 made by T. E. Law on the 3rd day of June 1997 (Gazette Notice No. 3757) and make the following declaration: Declaration The Order in Council under section 12 of the Submarine Cables and Pipelines Protection Act 1996, entitled the Submarine Cables and Pipelines Protection Order 1992, shall not apply in respect of the following ships or vessels: Vercors Raymond Croze Leon Thevenin KDD Ocean Link KDD Maru KDD Pacific Link ASEAN Restorer Sir Eric Sharp Pacific Guardian Cable Enterprise Seaspread CS Sovereign CS Monarch CS Iris Cable Installer CS Agile CS Nexus CS Cable Retriever CS Fresnel CS Kuroshio Maru CS Maersk Fighter CS Maersk Defender Cable Innovator Long Lines Charles L Brown Global Link Global Sentinel Global Mariner Coastal Connector MSV Fu Lai MV Dock Express and ROV, workboats, zodiacs and small craft associated with any of those vessels whilst working in the protected areas for the purpose of carrying out work on the laying, investigating, repairing or inspecting cables; including patrolling a protected area; and including the removal or placement of any material, equipment, or other matter from or in the area of the cables and while under the direct control of or working under instructions given in writing by Telecom New Zealand Limited for the period required by Telecom New Zealand Limited or for the period required to complete any work.
