Easement Acquired for Runway Lighting System Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Warranted Officer, Regional Crown Property Services, Land Information New Zealand, Wellington, declares that, agreement having been entered into, an easement over that part of the land marked `A' on S.O. Plan 37721 contained in certificate of title 42C/61, Wellington Land Registry (the ``servient land'') is hereby acquired for defence purposes upon the terms and conditions set out in the Schedule. Schedule 1. The Crown may erect and install lines of poles and buried electrical cable and lights on and under that part of the servient land marked `A' on S.O. Plan 37721 (the ``easement area'') for the purpose of assisting navigation, landing, and other operational activities of the Royal New Zealand Air Force. 2. The Crown may enter upon the servient land from time to time and at all times with such notice to the owners as shall be practicable for the purpose of gaining access to the easement area, with or without machinery, vehicles or equipment, for the purpose of carrying out repairs, maintenance or renewal of any of the said poles, lights or cables, and to open up the soil thereof to such extent as shall be necessary, provided that the surface shall be restored as nearly as possible to its original condition, and any other damage done is repaired or compensated, such repair maintenance or renewal work to be carried out with due regard to the owner's farming operations and as expeditiously as possible. 3. The owners may carry on normal pastoral operations on the easement area provided that the surface of the ground shall not be ploughed or broken up to such a depth as to endanger any buried electrical cables. 4. In the event that the Crown no longer requires the lighting easement acquired by this agreement, the Crown shall remove all poles, cables, and lights and concrete surrounds from the easement area and restore the ground so disturbed to a satisfactory standard of topsoil and regrassing at the cost of the Crown, and at a time suitable to the owner's farming operations, and the Crown will revoke this proclamation and surrender its interest in the land whether pursuant to section 54 of the Public Works Act 1981 or otherwise.
