Cable Easements in Gross Over Land and Land Acquired for Defence Purposes in Waitakere City Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Regional Crown Property Services, Land Information New Zealand, Auckland, declares that an agreement to that effect having been entered into, the land described in the First Schedule and the cable easement in gross in the Third Schedule over the land described in the Second Schedule are hereby acquired for defence purposes and shall vest in the Crown on the date of publication in the New Zealand Gazette. The Crown shall have the right to lay cables or erect overhead wires for the supply of electric power to the lands described in the First Schedule. 2. The Crown shall have the right to remove trees or obstructions above the level of the line of lights on the lands described in the First Schedule. 3. The Crown shall have the right, at its discretion, to impose a height restriction over the lands described in the First and Second Schedules should such a restriction be so required. 4. For the purpose of erecting, repairing or maintaining the approach lighting the Crown shall have the right of access to the easement land at the point at which normal access to the subject property is obtained. 5. The cable easement described herein shall be subject to the same rights and powers as those contained in the first, second and fifth paragraphs of the Seventh Schedule to the Land Transfer Act 1952 except that references to right of way, water and sewage shall be read as references to electricity and references to pipes shall include cables or overhead wires.
