Fisheries (Quota Aggregation Limit Exemption) Notice (No. 4) 1997 (No. F61) Pursuant to section 28w (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission and after having regard to the provisions of section 28w (5) of the Fisheries Act 1983, hereby gives the following notice: N o t i c e 1. Title and commencement (a) This note may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice (No. 4) 1997; (b) This notice shall come into effect on the day after its notification in the New Zealand Gazette. 2. Interpretation In this notice, ``Talley's Group'' means Talley Fisheries Limited, Amaltal Corporation Limited, Ocean Products Limited and McDonald & Brown Limited, and any companies owned or controlled by those companies. 3. Exemption to quota aggregation limit As from the date that this notice comes into effect, the Talley's Group is permitted to hold quota and interest in quota in excess of the aggregation limits as provided in section 28w (1) of the Fisheries Act 1983, up to the percentage limits as specified below: (i) An aggregation limit of 45 percent of the combined Total Allowable Commercial Catch for each of the following species: Alfonsino Ling Barracouta Orange Roughy Blue Warehou Oreo Dories Gemfish Packhorse Rocklobster Hake Red Cod Hoki Silver Warehou Jack Mackerel Squid (ii) An aggregation limit of 35 percent of the combined Total Allowable Commercial Catch for each of the following species: Blue Cod Red Cod Elephant Fish Rig Flatfish School Shark Gurnard Snapper Hapuku/Bass Stargazer John Dory (iii) An aggregation limit of 20 percent of the combined Total Allowable Commercial Catch for bluenose. 4. Revocation The Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 1997 is hereby revoked. Dated at Wellington this 4th day of August 1997. Hon. JOHN LUXTON, Minister of Fisheries.
