Summary of Exemptions Granted by Director of Civil Aviation Pursuant to section 37 of the Civil Aviation Act 1990, notification is hereby given of a summary of exemptions, set out in the Schedule hereto, granted by the Director of Aviation. Schedule In addition to the exemptions listed in the New Zealand Gazette 1995, No. 15, pages 150 and 151, in 1996, No. 65, pages 1638, 1639 and 1640, in 1996, No. 70, page 1761, in 1996, No. 139, page 3354, and in 1977, No. 1, page 54, the following have also been granted: Nature of exemptions granted: Docket 1228, to Mooney M20J serial No. 24-1009, on 8 April 1997. From 21.191 (a) (2) (i) and 21.191 (a) (2) (ii). To exempt Richard Neave and Sue Campbell, applicants for a certificate of airworthiness for the aircraft, from the requirement to provide evidence that a standard category type acceptance certificate has been issued in accordance with Civil Aviation Rule Part 21 and that a statement of conformity has been issued by the exporting country. Docket 1234, to Grumman Agcat serial No. 441, on 5 March 1997 and Agcat serial No. 1418, on 23 May 1997. From 21.191 (a) (2) (i) and 21.191 (a) (2) (ii). To exempt Pionair Adventures Limited and Frontair Aviation Limited, applicants for an airworthiness certificate for the aircraft, from the requirement to provide evidence that a standard category type acceptance certificate has been issued in accordance with Civil Aviation Rule Part 21 and that a statement of conformity has been issued by the exporting country. Docket 97/EXE/16, to Airways Corporation of New Zealand, on 13 May 1997. From 171.53 (a) (1) (ii), (a) (2) (ii), (a) (2) (iii), and (a) (4). To exempt them from the monitoring requirements for the Chatham Islands NDB and DME facilities. To remain in force until the affected facilities are replaced, or the exemption is withdrawn by the Director. Docket 97/EXE/20, to Hawke's Bay and East Coast Aero Club, on 8 April 1997. From 43.51 (a). To exempt them from the requirement that pilot maintenance can only be performed if the aircraft is not used for air transport operations, in the case of seat and stretcher equipment changes. Docket 97/EXE/24, to William John Funnell and Eric Wayne Pratt, on 28 February 1997. From 61.05 (f) and 61.225 (2). To exempt them from the requirement to obtain a current airline transport pilot licence for piloting a non-passenger carrying Mi-8MTV-1 helicopter. Provided they continue to hold a current commercial pilot licence (helicopter) and otherwise comply with Civil Aviation Rule Part 61. To remain in force until 28 February 1998, or the exemption is withdrawn by the director. Docket 97/EXE/26, to gliders and manned free balloons being operated in transponder-mandatory airspace, on 27 March 1997. From 91.541 (a) (2). To exempt them from the requirement that each aircraft be equipped with and SSR transponder having automatic Mode C altitude reporting capability. To remain in force until 1 April 1998, or the exemption is withdrawn by the director. Docket 97/EXE/28, to pilots of aerobatic aircraft in certain conditions, to pilots performing parachute drops, and to pilots towing gliders or other objects, on 27 March 1997. From 91.701, 91.705, 91.709, and 91.711. To exempt them from the requirement that each have the specific rating required by Part 91 for that task, so long as they comply with stated conditions. To remain in force until 31 March 1998, or the exemption is withdrawn by the director. Docket 97/EXE/29, to Michael Anthony Pervan, Ross John McLeod, John Richard Leaper, William Robert Hughes, Christopher John Field, John Reuben Thomson, Mark Henry Hobson, Jeffery James Gibbs, Peter Leslie Frew, and Allan John Knox of Air New Zealand Limited, on 27 March 1997. From Part 146 Appendix A. To exempt them from the requirements, privileges, and limitations of Appendix A regarding the approval of design changes, while they comply with delegations approved under regulation 176. To remain in force until the approval issued, under regulation 176 of the Civil Aviation Regulations 1953, to Air New Zealand Limited expires or until 31 March 1998, whichever is sooner. Docket 97/EXE/30, to any operator of an aircraft under IFR in cruise from TOC to TOD, on 27 March 1997. From 91.7 (c) (3). To exempt them from the requirement to not operate any portable electronic device in critical phases of flight in IFR conditions. To remain in force until 1 April 1998, or the exemption is withdrawn by the director. Docket 97/EXE/32, to each person operating an aircraft requiring an annual review of airworthiness in accordance with 91.619 (a), on 26 March 1997. From 91.619 (b). To exempt them from the requirement that an annual review of maintenance be performed within the preceding 12 months, and to allow that review to be completed at the expiry of any maintenance release valid at 31 March 1997. Docket 97/EXE/33, to South Pacific Air Charters Limited, on 27 March 1997. From 139.305 (5). To exempt them from the requirement that any place for landing or taking off has to be certificated under Part 139, while using any place that is outside New Zealand. To remain in force until the exemption is withdrawn by the director. Docket 97/EXE/37, to each person operating an aircraft under visual flight rules, on 27 March 1997. From 91.611 (a) (1). To exempt them from the requirement that an altimeter system inspection be completed within the previous 24 months, so long as the system inspection is completed before 1 January 1999. Docket 97/EXE/39, to each pilot in command operating an aircraft under VFR within Class C, D, or E airspace, on 4 April 1997. From 91.301 (a) (2). To exempt them from the requirement to remain at a distance of 1000 feet vertically from clouds while in a control zone, provided the aircraft is being operated clear of clouds. To remain in force until the exemption is withdrawn by the director. Docket 97/EXE/40, to Inglis Aircraft Limited, on 13 May 1997. From 21.191 (b) (7). To exempt that applicant for an airworthiness certificate for Jetstream 31 aircraft from the requirement that the aircraft conform with the applicable additional airworthiness requirements prescribed in Part 26 Appendix C.2.1 (b), namely that an air transport aeroplane with a type certificated seating capacity of between 16 and 23 passengers be equipped with 1 exit on the same side as the passenger entrance door and 2 exits on the side opposite the passenger entrance door. To remain in force while the aircraft meet the requirements of US FAR 23.807 (b) in effect on 10 May 1993. Docket 97/EXE/44, to aircraft with inoperative instruments or equipment, on 24 April 1997. From 91.537 (a) (1). To exempt them from the requirement to have a minimum equipment list approved according to 91.539, provided they have a list approved by regulation 108, of the Civil Aviation Regulations 1953, that is valid on 31 March 1997. To remain in force until 1 October 1997, or the exemption is withdrawn by the director. Docket 97/EXE/47, to Inglis Aircraft Limited, on 19 May 1997. From 135.605 (a) (2). To exempt them from the requirement that the holder of an air operator certificate shall ensure that its flight examiners have an appropriate rating. To remain in force until 3 months after a flight examiner rating has been established by amendment to Part 61, or the exemption is withdrawn by the director. Docket 97/EXE/50, to each pilot in command of an aircraft being operated under VFR with Class C, D, or E airspace that is a control zone, on 20 May 1997. From 91.301 (a) (2). To exempt them from the requirement to remain at a distance of 1000 feet vertically from clouds while in a control zone, provided the aircraft is being operated not less than 500 feet vertically from clouds. To remain in force until the exemption is withdrawn by the director. Withdrawn by the director on 20 May 1997, refer to Docket 97/EXE/50.
