Land and Interests Over Land Acquired in Rodney District Pursuant to section 20 of the Public Works Act 1981, to section 88 (2) of the Transit New Zealand Act 1989, and to a delegation from the Minister of Lands, the Manager, Regional Crown Property Services, Land Information New Zealand, Auckland, declares that, an agreement to that effect having been entered into, the land contained in the First Schedule is acquired for a limited access road, which becomes road, limited access road, and State highway; and the right to convey and discharge water over the land described in the Second Schedule, containing the rights and powers contained in the third and fifth paragraphs of the Seventh Schedule of the Land Transfer Act 1952, and as modified by the additional terms and conditions contained in the Third Schedule, is acquired in connection with a limited access road, and the said land and easement as an easement in gross and perpetuity, shall vest in the Crown on the date of publication in the New Zealand Gazette. First Schedule North Auckland Land District 43 square metres, being part Lot 1, D.P. 64550; shown marked ``A'' on S.O. Plan 68455, lodged in the office of the Chief Surveyor at Auckland. Second Schedule Drainage Easement in Gross Area m Being 20 Part Lot 1, D.P. 64550; shown marked ``B'' on plan. 60 Part Lot 1, D.P. 64550; shown marked ``C'' on plan. Shown marked as above mentioned on S.O. Plan 68455, lodged in the office of the Chief Surveyor at Auckland. Third Schedule Rights and Powers In this declaration ``the Crown'' includes but is not limited to Her Majesty the Queen and her heirs, successors and assigns acting by and through Transit New Zealand (or any successor body) pursuant to the Transit New Zealand Act 1989 and the Public Works Act 1981. The Crown shall be solely liable for all of the future maintenance of the easement areas and all costs associated with that maintenance or repair. The easement is one in perpetuity, however, if the Crown, at her sole discretion, should decide that all or part of the easement is no longer required, the easement may be fully or partially surrendered either by memorandum of transfer or by declaration published in the New Zealand Gazette, pursuant to section 42 (4) of the Public Works Act 1981.
