Land Acquired for a State Primary School in Waitakere City Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares that, an agreement to that effect having been entered into, the land described in the First Schedule is acquired, subject to the covenant as to fencing described in the Second Schedule hereto, for a State primary school and shall vest in the Crown on the date of publication in the New Zealand Gazette. First Schedule North Auckland Land District 2139 square metres, being part Lot 1, D.P. 9146; shown marked ``A'' on S.O. Plan 67766, lodged in the office of the Chief Surveyor at Auckland. Second Schedule North Auckland Land District Bruce Andrew Anderson, company director and Leonie Dawne Murray, married woman, both of Auckland ``the vendors'' are the surviving executors of the estate of James Neil Anderson and are the registered proprietors of the balance of the land comprised in certificate of title 4A/1482, North Auckland Land Registry ``the adjoining land'' and Her Majesty the Queen for a State primary school is ``the purchaser'' pursuant to an agreement for sale and purchase, dated 8 May 1996 and the vendors and the purchaser have mutually covenanted that the vendors shall not be liable to pay for or contribute towards the expense of erection or maintenance of any fence between the property herein acquired and any adjoining land of the vendors EXCEPT THAT this proviso shall not enure for the benefit of any subsequent purchaser of the adjoining land.
