Fisheries (Notification of Proposal to Establish the Kawhia/Aotea Harbours and Adjacent Coastal Waters as a Taiapure Local Fishery) Notice 1996 (No. F32) Pursuant to section 54d (2) of the Fisheries Act 1983, the Chief Executive of the Ministry of Fisheries, acting under an authorisation from the Minister of Fisheries, hereby gives the following notice: N o t i c e 1. Title and commencement (1) This notice may be cited as the Fisheries (Notification of Proposal to Establish the Kawhia/Aotea Harbours and adjacent coastal waters as a Taiapure Local Fishery) Notice 1996. (2) This notice shall come into effect on the day after its notification in the New Zealand Gazette. 2. Proposal (1) A proposal by the Tainui Maori Trust Board, the Maniapoto Maori Trust Board and the Ngati Raukawa Trust Board to establish the Kawhia/Aotea Harbours and adjacent coastal waters as a taiapure local fishery has been agreed to in principle by the Minister of Fisheries, after consultation with the Minister of Maori Affairs and after having regard to the provisions of section 54b (3) of the Fisheries Act 1983. (2) The area that is subject to the proposal is as follows: AREA 1: The area enclosed by a line commencing at the mean high water mark at Tirua Point on the west coast of the North Island (at 38 23.45S; 174 38.00E), then proceeding directly through a north westerly direction to a point 38 23.00S; 174 35.40E; thence proceeding in a northerly direction along a line every point of which is 2 nautical miles seawards of the mean high water mark along the coast to a point 38 06.75S; 174 38.25E; then proceeding directly through a easterly direction to the mean high water mark at Albatross Point on the west coast of the North Island (at 38 06.75S; 174 40.80E) and thence to the point of commencement at Tirua Point (38 23.45S; 174 38.00E). AREA 2: The area enclosed by a line commencing at the mean high water mark at Albatross Point on the west coast of the North Island (at 38 06.75S; 174 40.80E), thence proceeding directly through a westerly direction to a point 38 06.75S; 174 38.25E; thence in a northerly direction along a line to a point 37 58.40S; 174 41.70E; thence proceeding in an easterly direction to the mean high water mark at Taranaki Point on the west coast of the North Island (at 37 58.40S; 174 46.75E); thence along the mean high water mark of the coast to include all internal waters of Aotea Harbour and Kawhia Harbour to the point of commencement at Albatross Point 38 06.75S; 174 40.80E. AREA 3: The area within a one nautical mile radius centred on Gannet Island 37 58.40S; 174 34.00E. 3. Public inspection of proposal (1) A copy of the proposal is available for public inspection, for a period of 2 months as from the date of publication of this notice in the New Zealand Gazette, at the following addresses: (a) Maori Land Court, corner of Anglesea and Knox Streets, Hamilton; (b) Ministry of Fisheries Head Office, ASB Bank House, 101103 The Terrace, Wellington; (c) Ministry of Fisheries, 23 Hargreaves Street, College Hill, Auckland; (d) Waikato District Council; 1 Clyde Street, Hamilton East; (e) Otorohanga District Council, Maniapoto Street, Otorohanga; (f) Waitomo District Council; Queen Street, Te Kuiti; and (g) Environment Waikato, 401 Grey Street, Hamilton. 4. Objections to, and submission on, proposal (1) Any person or public authority, local authority, or any body specifically constituted by or under any Act, and any Minister of the Crown, which or who has any function, power, or duty which relates to, or which or who is or could be affected by any aspect of the proposed taiapure local fishery may by 20 August 1996, being 2 months from the date of publication of this notice in the New Zealand Gazette, lodge an objection to, and/or submission on the proposal at the office of the Maori Land Court referred to in clause 3 (a) above. (2) All objections and submissions on the proposal shall: (a) Identify the grounds on which the objections or submissions are made; and (b) Be supplemented by such particulars or information as the Registrar of the Maori Land Court notifies the applicant that the Registrar of the Maori Land Court considers necessary to sufficiently identify the grounds for the objections or submissions.
