Provisional Direction: 10 mm Plasterboard From Thailand Pursuant to section 16 (1) of the Dumping and Countervailing Duties Act 1988 (``the Act''), I hereby give notice that, on the basis of the information made available during the investigation to date, I have reasonable cause to believe, in relation to the importation or intended importation of the goods specified in the First Schedule to this notice, (``the subject goods'') (a) The subject goods are being dumped; and (b) By reason thereof material injury to the New Zealand plasterboard industry is being threatened, and also I am satisfied that action under section 16 of the Act is necessary to prevent material injury during the period of investigation. Pursuant to section 16 (1) of the Act, I hereby give notice of a provisional direction that payment of anti-dumping duty set out in the Second Schedule to this notice, in respect of the subject goods, shall be secured in accordance with Part IX of the Customs Act 1966. FIRST SCHEDULE Goods Subject To Investigation Country of Origin Thailand. Description of Goods Standard plasterboard with dimensions falling between a thickness of 8.75 mm to 10.25 mm of any length or width other than those dimensions already subject to anti-dumping duty. The goods are currently classified under Tariff Item and Statistical Key 6809.11.00 10D of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive. SECOND SCHEDULE Amount of Anti-Dumping Duty to be Secured The amount of anti-dumping duty to be secured in respect of subject goods, imported or intended to be imported into New Zealand from Thailand, shall be equal to the amount by which the free-on-board value (being ``Customs value'' as defined in section 2 (1) of the Customs Act 1966) is less than the non-injurious free-on-board import price of NZ$2.0865 per m.
