Final Determination and Imposition of Anti-Dumping Duty: Automotive Oil Filters From the U.S.A., Amendment No. 2 (Review and Duty Reassessment) Pursuant to section 14 of the Dumping and Countervailing Duties Act 1988 (``the Act''), as in force immediately before the commencement of the Dumping and Countervailing Duties Amendment Act 1994, in accordance with section 21 of the 1994 Act, the Minister of Commerce, having carried out a review and reassessment of anti-dumping duty in respect of imports into New Zealand of Automotive Oil Filters from the U.S.A. and having determined a new anti-dumping duty applicable to those goods, gives the following notice. N o t i c e 1. Title and commencement (1) This notice may be cited as the Final Determination and Imposition of Anti-Dumping Duty: Automotive Oil Filters from the U.S.A., Amendment No. 2 (Review and Duty Reassessment), and shall be read together with and deemed part of the notice entitled ``Final Determination and Imposition of Anti-Dumping Duty: Automotive Oil Filters from the U.S.A.'',* (``the principal notice''). (2) This notice shall come into force on the day after the date on which it is published in the New Zealand Gazette. The reassessed rates of anti-dumping duty, set out in the Schedule to this notice, shall apply to imports of the goods specified in the said Schedule with effect from 1 April 1996. 2. Amendment to anti-dumping duty applicable The principal notice is hereby amended by omitting the Schedule as substituted by the notice in the New Zealand Gazette of 14 July 1994, entitled ``Final Determination: Dumping Investigation in Respect of Automotive Oil Filters from the U.S.A., Amendment No. 1'' and substituting the Schedule set out in the Schedule to this notice. 3. Consequential revocation The notice entitled ``Final Determination and Imposition of Anti-Dumping Duty: Automotive Oil Filters from the U.S.A., Amendment No. 1'', published on pages 2286 and 2287 of the New Zealand Gazette of 14 July 1994, is hereby revoked. * Dated 27 November 1992 and published on pages 4387 and 4388 of the New Zealand Gazette of 3 December 1992. Schedule New Second and Third Schedules to Principal Notice ``Second Schedule Amount of Anti-Dumping Duty The amount of anti-dumping duty to be paid on demand in respect of each importation of the subject goods shall be: A. For subject goods from the suppliers and exporters listed in Schedule Three below for which the Secretary of Commerce has established Normal Value (Value for Duty Equivalent) amounts, the amount by which the Normal Value (Value for Duty Equivalent) amount exceeds the New Zealand Value for Duty of those goods when entered for home consumption: B. For subject goods from the suppliers and exporters listed in Schedule Three below for which the Secretary of Commerce has not established a Normal Value (Value for Duty Equivalent) amount, the rate of duty represented by the weighted average dumping margin established from the Normal Value (Value for Duty Equivalent) amounts by the Secretary of Commerce for that supplier or exporter: C. For subject goods from any other suppliers and exporters, a rate of duty being the weighted average margin of dumping established by the Secretary of Commerce for those suppliers and exporters listed in Schedule Three below. The rate established for the type of goods in this category is 9.6 percent ad valorem. Third Schedule List of Suppliers and Exporters Suppliers and exporters for whom Normal Value (Value for Duty Equivalent) amounts, have been established for types of the subject goods, are: AlliedSignal Inc. Fleetguard Inc. (including Fleetguard Australia). Purolator Products Company Inc. System One Filtration Ltd. K and N Engineering Ltd. Baldwin Filters Ltd. Reliable Industries Ltd. Roclun International Ltd. Champion Laboratories. Perf-form Products Ltd. Detroit Engine and Turbine Ltd. Caterpillar (including Caterpillar Australia). Mustang Manufacturing Company Ltd. The Normal Value (Value for Duty Equivalent) amount is the sum of the normal value established in the review and any adjustments made in accordance with section 4 (1) (a) of the Act in order to establish export prices. New Zealand Customs holds schedules of Normal Value (Value for Duty Equivalent) amounts and weighted average dumping margins for the suppliers and exporters listed in the Third Schedule to this notice. These amounts are confidential to the suppliers concerned.'' Dated at Wellington this 8th day of April 1996. JOHN LUXTON, Minister of Commerce. Note: The original determination provided a mechanism by which suppliers and exporters other than those investigated, could request that Normal Value (Value for Duty Equivalent) amounts be established. This mechanism enabled the updating of existing schedules and the addition of new filters to those schedules. The Explanatory Note to the principal notice invited suppliers and exporters to lodge requests, backed by the necessary supporting evidence, for the establishment of these values. Since the original determination, Normal Value (Value for Duty Equivalent) amounts have been established for additional suppliers and exporters, and further oil filters have been added to the schedules relating to the suppliers investigated. Following the review and reassessment the same system remains available to suppliers and exporters. Normal Value (Value for Duty Equivalent) amounts established by the Secretary of Commerce following such requests will be advised to the suppliers or exporters concerned, and to New Zealand Customs. Public notice of the establishment of additional or updated schedules of Normal Value (Value for Duty Equivalent) amounts will be given as necessary by notice in the New Zealand Gazette.
