Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 4 (Duty Reassessment) Pursuant to section 14 of the Dumping and Countervailing Duties Act 1988 (``the Act'') as in force immediately before the commencement of the Dumping and Countervailing Duties Amendment Act 1994, in accordance with section 21 of the Dumping and Countervailing Duties Amendment Act 1994, the Minister of Commerce, having carried out a review and reassessment of anti-dumping duty in respect of imports into New Zealand of certain plasterboard from Thailand and having determined a new anti-dumping duty applicable to those goods, gives the following notice. N o t i c e 1. Title and Commencement (1) This notice may be cited as the Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand*, Amendment No. 4, and shall be read together with and deemed part of the notice entitled ``Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand'' dated 21 December 1989 and published on page 4 of the New Zealand Gazette of 11 January 1990 (hereinafter referred to as the principal notice). (2) The reassessed anti-dumping duty, set out in the Schedule to this notice, shall apply to imports of the goods specified in the said Schedule with effect from the day after the date of its publication in the New Zealand Gazette. 2. Amendment to anti-dumping duty applicable The principal notice is hereby amended by omitting the Schedule as substituted by the notice in the New Zealand Gazette of 11 May 1995 entitled ``Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 3 (Duty Reassessment)'', and substituting the Schedule set out in the Schedule to this notice. 3. Consequential revocation The notice entitled ``Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 3 (Duty Reassessment)'', and published on pages 1143 and 1144 of the New Zealand Gazette of 11 May 1995, is hereby revoked. Schedule New Schedule to Principal Notice ``Schedule Amount of Anti-Dumping Duty The anti-dumping duty which is to be collected and paid on demand of the Collector in respect of each importation of plasterboard Being standard plasterboard having nominal dimensions of 9 mm or 9.5 mm thickness by 1200 mm width by 2400 mm to 3600 mm length, imported or intended to be imported into New Zealand from Thailand, shall be equal to the amount by which the free-on-board value (being ``Customs value'' as defined in section 2 (1) of the Customs Act 1966) is less than the non-injurious free-on-board import price of NZ$2.0865 per m.'' Explanatory Note This note is not part of the notice, but is intended to indicate its general effect. This notice, issued under section 14 of the Dumping and Countervailing Duties Act 1988, amends the notice entitled ``Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand'' dated 21 December 1989, published on page 4 of the New Zealand Gazette of 11 January 1990 and revokes the notice entitled ``Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 3 (Duty Reassessment)'', and published on pages 1143 and 1144 of the New Zealand Gazette of 11 May 1995. The effect of the notice is to revoke the imposition of anti-dumping duty on foil-backed plasterboard and increase the non-injurious FOB level which provides the basis for the calculation of anti-dumping duty for standard plasterboard imported from Thailand of the nominal dimensions specified in the notice.
