Public Notice The Treaty of Waitangi Act 1975 The State-Owned Enterprises Act 1986 This notice concerns land at 91 Airedale Street, Auckland, and Maori claims under the Treaty of Waitangi Act 1975. Read this notice carefully. It may affect your right to make a claim to the Waitangi Tribunal to ask for the return of former Crown lands. If you do not fully understand this notice, you should get legal advice, or contact the Waitangi Tribunal at the address given below. The land at 91 Airedale Street is described in legal terms as all that parcel of land containing 2117 square metres, more or less, being Section 1, Survey Office Plan 65928, being all of the land comprised and described in certificate of title 86D/144 (North Auckland Registry) and subject to: 1. Section 27b of the State-Owned Enterprises Act 1986; 2. Part IVa of the Conservation Act 1987; 3. Section 3 of the Petroleum Act 1937; 4. Section 8 of the Atomic Energy Act 1945; 5. Section 3 of the Geothermal Energy Act 1953; 6. Sections 6 and 8 of the Mining Act 1971; 7. Sections 5 and 261 of the Coal Mines Act 1979; 8. Section 11 of the Crown Minerals Act 1991; 9. Mortgage C. 532483.1; and 10. Mortgage C. 910692.4. The land was once owned by the Crown. It was transferred to a state-owned enterprise under the State-Owned Enterprises Act 1986. There is a special notice or ``memorial'' on the certificate of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27a and 27b of the State-Owned Enterprises Act 1986). The current owners of the land, Inner City Properties Limited, have applied to the Waitangi Tribunal to have this notice removed. The application has been made under section 8d of the Treaty of Waitangi Act 1975. ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THIS LAND, SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 29TH DAY OF NOVEMBER 1996. Section 6 of the Treaty of Waitangi Act 1975, describes what a claim is. Claims may be posted or sent tothe Registrar, Waitangi Tribunal, Seabridge House, 110 Featherston Street (P.O. Box 5022), Wellington. If no claim about this land is made to the Waitangi Tribunal before the 29th day of November 1996, then the Tribunal may recommend that the land no longer be liable to be resumed by the Crown and returned to Maori ownership under section 27b of the State-Owned Enterprises Act 1986.
