EJ Drake Trust Notice of Application for an Order Approving Scheme Under Part III of the Charitable Trusts Act 1957 Notice is hereby given that the EJ Drake Trust Board has applied to the High Court at Auckland for an order approving a scheme under Part III of the Charitable Trusts Act 1957, to vary the terms of the will of Edward John Drake, farmer of Auckland, and a deed of charitable trust under which the EJ Drake Trust (being the deceased's residuary estate) is held. Under the proposed amended will and amended deed of charitable trust, the EJ Drake Trust Board will be empowered to apply the capital fund of the EJ Drake Trust and the whole or any part of income arising from the EJ Drake Trust in the provision, construction, maintenance and upkeep of any buildings forming or to form part of the West Auckland Area Returned Services Association Home for the Elderly and shall make payments for these purposes to the West Auckland Area Returned Services Association Home for the Elderly Trust.
