Right of Way Easement Acquired at Holdens Hill Gisborne District Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Gisborne, declares that, an agreement to that effect having been entered into, the easement described in the Third Schedule hereto is acquired as an easement forever appurtenant to the land described in the Second Schedule over those parts of the land described in the First Schedule as are specified in the Third Schedule. The easement shall vest in the Crown (the grantee) on the date of publication in the New Zealand Gazette for post office purposes (VHF station). Gisborne Land District First Schedule (Servient Tenement) Area ha Being 335.6101 Sections 1 & 2, S.O. 7937 and part Lot 2 on Deposited Plan 6042, being all of the land comprised in certificate of title 5A/1489. 257.0654 Part Lot 1, Deposited Plan 6254, being all of the land comprised in certificate of title 5A/111. Second Schedule (Dominant Tenement) 70 square metres, being Section 2, Block XVI, Waimata Survey District, being all of the land comprised in certificate of title 5B/522. Third Schedule (Right of Way Easement) A right of way over those pieces of the land in the First Schedule described as follows: Part Lot 1, D.P. 6254; shown marked ``A'' and ``C'' on S.O. 8685. Part Lot 2, D.P. 6042; shown marked ``B'' on S.O. 8685. S.O. 8685 is held in the office of the Chief Surveyor at Gisborne. Additional Rights & Conditions Included in the Easement 1. The grantee shall not be required or empowered to fence the boundaries of the right of way. 2. The registered proprietor may fence across the right of way but in so doing so shall erect within such fence a farm gate which will permit the passage of vehicles along the said right of way. 3. The use of the right of way by the grantee shall be restricted to vehicles and personnel under the control and direction of the grantee. 4. The grantee shall ensure that all farm gates that have been erected to permit passage along the said right of way are closed and latched after each passage of a vehicle belonging to the grantee or under the direction and control of the grantee. 5. The grantee shall be responsible for all maintenance costs required to maintain the right of way to a standard acceptable to the grantee. 6. Except as varied herein the rights and powers contained in the Seventh Schedule of the Land Transfer Act 1952 shall apply. Dated at Gisborne this 26th day of September 1994. R. H.
