Declaring Railway Land at Dunedin to be Disposed of and Vested in The Dunedin City Council for Freehold Investment Purposes Pursuant to sections 24 and 30 of the New Zealand Railways Corporation Act 1981 and sections 20 and 50 of the Public Works Act 1981, the Chief Executive of the New Zealand Railways Corporation, with the prior written consent of the Minister of Railways, hereby declares the land described in the First Schedule hereto, to be disposed of and vested in The Dunedin City Council for freehold investment purposes; pursuant to section 28 of the Public Works Act 1981, reserving an easement in gross described in the Second Schedule hereto, over the land described in the Third Schedule hereto, for a right of way forever in favour of the New Zealand Railways Corporation (called the grantee); reserving also an easement in gross described in the Fourth Schedule hereto, over the land described in the Fifth Schedule hereto, for a right to convey electricity and telephonic communications forever in favour of the New Zealand Railways Corporation (called the grantee). First Schedule Otago Land District Dunedin City Land Vested All that piece of railway land containing 9357 square metres, situated in Town of Dunedin, being Section 2, S.O. 24068, lodged in the office of the Chief Surveyor at Dunedin. Second Schedule Easement in Gross for a Right of Way The rights and powers implied in and attached to a right of way as set out in the Seventh Schedule of the Land Transfer Act 1952. Third Schedule Otago Land District Dunedin City Land Subject to an Easement in Gross for a Right of Way Part Section 2, S.O. 24068, situated in Town of Dunedin, being more particularly shown marked ``A'', ``E'', ``F'' and ``D'' on S.O. 24068, lodged in the office of the Chief Surveyor at Dunedin. Fourth Schedule Easements in Gross for a Right to Convey Electricity and Telephonic Communications The rights and powers being the same as the rights and powers implied in and attaching to a ``right to convey water'' as set out in the Seventh Schedule of the Land Transfer Act 1952 with ``the right to lay pipes'' being replaced by ``the right to lay cables''. Fifth Schedule Otago Land District Dunedin City Land Subject to an Easement in Gross for a Right to Convey Electricity and Telephonic Communications Part Section 2, S.O. 24068, situated in Town of Dunedin, being more particularly shown marked ``B'', ``C'' (above Reduced Level 107.15 metres, Otago Level Datum) and ``D'' on S.O. 24068, lodged in the office of the Chief Surveyor at Dunedin.
