Fisheries (Quota Aggregation Limit Exemption) Notice 1994 (No. 5346) Pursuant to section 28w (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission hereby gives the following notice: N o t i c e 1. Title and commencement (1) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice 1994. (2) This notice shall come into effect on the day after its notification in the New Zealand Gazette. 2. Interpretation In this notice: (a) Any reference to Quota Management Area means the appropriate Quota Management Area as defined in the Fisheries (Quota Management Areas, Total Allowable Catches and Catch Histories) Notice 1986*; (b) Species are specified by way of fishstock codes, being Fishstock Codes defined in the Second Schedule of the Fisheries (Reporting) Regulations 1990; and (c) ``Sanford Group'' means Sanford Limited and those companies owned or controlled by Sanford Limited at the date of this notice and Wanganui Seafoods Limited and any of its subsidiary companies. 3. Exemption to quota aggregation limit (1) As from the date that this notice comes into effect, the Sanford Group is permitted to hold quota and interest in quota in excess of the 20 percent aggregation limit for quota management areas 1, 2, 3, 4, 5, 6, 7, 8 and 9 as provided in section 28w (1) (d) of the Fisheries Act 1983, for the following species, up to the percentage limits as specified in the table below: [tn1,3] Species Fishstock Quota Aggregation Limit % [tn1,3] Barracouta BAR 1 26.11 Barracouta BAR 4 34.29 Barracouta BAR 5 24.98 Barracouta BAR 7 23.84 Blue warehou WAR 3 24.40 Blue warehou WAR 7 21.06 Gemfish SKI 3 24.65 Gemfish SKI 7 32.51 Jack mackerel JMA 7 28.71 Snapper SNA 8 51.10 Stargazer STA 5 21.58 Tarakihi TAR 4 28.09 Trevally TRE 7 47.04 [tn1,3] (3) The consent with respect to the fishstocks STA 5, TAR 4, and TRE 7, as specified in the table, is valid for a period of 2 years from the date that this notice comes into effect. (4) As from the date that this notice comes into effect, the Sanford Group is permitted to hold quota and interest in quota in excess of the 35 percent aggregation limit established for species named in Schedule 1A to the Fisheries Act 1983, as provided in section 28w (1) (a) of the Fisheries Act 1983, in respect of the species silver warehou, up to an aggregation limit of 35.29 percent.
