The Fire Appliances (Code of Practice for Ships of Classes VII, VIIA and VIII) Notice 1989, Amendment No. 1 Pursuant to section 235 of the Shipping and Seamen Act 1952, the Minister of Transport hereby gives the following notice. N o t i c e 1. Title and commencement (1) This notice may be cited as the Fire Appliances (Code of Practice for Ships of Classes VII, VIIA and VIII) Notice 1989, Amendment No. 1 and shall be read together with and deemed part of the Fire Appliances (Code of Practice for Ships of Classes VII, VIIA and VIII) Notice 1989 (hereinafter referred to as the principal notice). (2) This notice shall come into force on the 30th day of May 1994. 2. Clauses amended (1) Clause 1 of the Schedule to the principal notice is hereby amended by revoking the definition of ``New ship'' and substituting the following definition: `` `New ship' means a ship of which the keel was laid, or in respect of which a similar stage of construction is reached: (a) in the case of a ship of Classes VII, VIIA, and VIII with a gross tonnage of 500 or more, on the 1st day of September 1984; and (b) in the case of a ship of Classes VII, VIIA, and VIII with a gross tonnage of less than 500, on the 1st day of November 1989; and for the purpose of this definition, ``similar stage of construction'' means the stage at which construction identifiable with the ship comprises at least 50 tonnes or 1 percent of the estimated mass of the structural material of the completed ship, whichever is the less.'' (2) The Schedule to the principal notice is hereby amended by revoking clause 2 and substituting the following clause: ``2. Application Part I of this Code of Practice applies to ships of Classes VII, VIIA, and VIII with a gross tonnage of 500 or more, unless otherwise stated, except ships of Class VIII which are hydrofoil or surface effect ships.'' (3) The Schedule to the principal notice is hereby amended by revoking subclauses (2), (3) and (4) of clause 3. (4) Clauses 4 (1), 4 (2), 4 (5), 5 (1), 5 (2), 7 (1), 8 (1), 11, 12 (1), 13, 15 (1), 16, 17 (1), 19 and 22 of the Schedule to the principal notice are hereby amended by inserting, after the word ``every'' wherever it occurs, the word ``new''. (5) Clauses 5 (3), 6, 9, 10, 17 (3), 18 and 20 of the Schedule to the principal notice are hereby amended by inserting, after the word ``every'' in line 1, the word ``new''. (6) Clause 21 (1) of the Schedule to the principal notice is hereby amended by inserting, after the word ``every'' in line 2, the word ``new''. (7) Subclauses (3) and (4) of clause 4 of the Schedule to the principal notice is hereby amended by inserting, after the words ``in any'' in line 1, the word ``new''. (8) The Schedule to the principal notice is hereby amended by inserting, after clause 13, the following clause: ``13A. Existing Ships (1) Every existing ship of Classes VII, VIIA, and VIII with a gross tonnage of 500 or more, the keel of which was laid before 25 May 1980 shall comply with the requirements of the International Conference on Safety of Life at Sea 1960, Chapter II - Part E, Regulations 55 to 58 inclusive and Regulations 60 to 63 inclusive and Regulation 65. (2) Every existing ship of Classes VII, VIIA, and VIII with a gross tonnage of 500 or more, the keel of which was laid on or after 25 May 1980 but before 1 September 1984, shall comply with the requirements of the International Conference on Safety of Life at Sea 1974, Chapter II-2, Part D, Regulation 52 (if a cargo ship) or Chapter II-2, Part E, Regulations 55 and 60 as amended by the 1978 Protocol, and Regulations 63 and 64 (if a tanker).''
