At its meeting on 25 July 2000, the Dairy Board resolved (Board Resolution No: 11306) to approve the Terms and Conditions of Herd Testing Licences issued by the
New Zealand Dairy Board pursuant to the Herd Testing Regulations 1958 as set out below, to take effect on the issue of any new licences.

TERMS AND CONDITIONS OF HERD TESTING LICENCES ISSUED BY NEW ZEALAND DAIRY BOARD
Pursuant to its powers under the Dairy Board Act 1961 and the Herd Testing Regulations 1958, the New Zealand Dairy Board ("NZDB") sets the following terms and conditions ("Conditions") to apply to all herd testing licences issued by the NZDB. The purpose of these Conditions is to ensure the integrity of data supplied to or held in the National Dairy Herd Improvement Database ("Database") by:
(a) setting and maintaining uniform standards for the accurate collection and processing of all herd testing data; and
(b) ensuring that all herd testing in New Zealand is conducted in a consistent and uniform manner nationwide.
The integrity of herd testing data is essential in order to optimise milk quality and the rate of genetic gain in the national dairy herd to the benefit of the New Zealand dairy industry.
Licence Holder to Supply All Herd Testing Data
1.1 The Licence Holder shall faithfully and accurately collect and supply to the Database Manager all herd testing data relating to its herd testing activities and such other data as may be required from time to time by the Database Manager. All data shall be provided strictly in accordance with any time limits prescribed by these Conditions or by the Database Manager, or where no time is specified, forthwith as soon as reasonably possible. In default of the Licence Holder supplying such data, the Database Manager may obtain these.
1.2 The Licence Holder shall supply to the Database Manager, within 7 days of the data coming under its control, a copy of the RDIPM for every animal for which information is received or recorded by the Licence Holder.
1.3 The Licence Holder shall supply to the Database Manager before 31 July in each year such data as will enable the Database Manager to provide NZDB with a summary of its herd testing operations showing all herds, cows and samples tested and test results for the previous 12 month season for which the licence has been granted.
1.4 All data collected by the Licence Holder pursuant to a herd testing licence shall be supplied to the Database Manager and not to any other person, except as is otherwise permitted in accordance with the Access Code.
Integrity of Information
2.1 The Licence Holder shall ensure that all data it supplies is valid, accurate and complete in accordance with the Database Manager's requirements.
2.2 The Licence Holder shall take out or maintain adequate insurance against any failure, breach or default of these Conditions by the Licence Holder and hereby indemnifies the NZDB in respect of all damages, costs, claims or expenses (including legal fees) incurred by or awarded or made against the NZDB and arising out of or in connection with such failure, default or breach.
2.3 The Licence Holder shall comply with all methods or systems of identification of farms, farmers, herds, animals, locations and stored genetic material, and with all quality control procedures and record formats that may from time to time be required by the Database Manager.
2.4 The Licence Holder shall on request (but no more frequently than annually) demonstrate to the satisfaction of the Database Manager or the NZDB that it operates quality control procedures to ensure as far as it is practicable that the animal details, the location details for the herd and the herd testing results it has reported for each animal, are suitable for use in animal evaluation and for research, in that:
(a) Up-to-date, complete and accurate date of birth, identification, mating and birth details for each animal that has been in the herd during the period that the herd test service has been provided by the licence holder are recorded on the database.
(b) The lactation identification and test day production detail information associated with each animal can be field verified to the specific cow;
(c) The cows tested are not treated in any way so as to cause the herd test results for the period they are reported to represent to be other than representative of the normal production for the cow for that period;
(d) Where a cow or a group of cows from a herd are separated from the rest of the herd and/or receive different treatment or management, such separation or differing treatment is advised to the database manager;
(e) The milk tested or the sample taken to determine composition has not been modified in any way to cause the results of the composition analysis to be other than an accurate reflection of the production from the cow; and
(f) Any abnormalities associated with the production of an individual cow or the quality/treatment of samples used for milk analysis are indicated by use of the appropriate codes.
2.5 The Licence Holder shall ensure that the equipment and methods used for the purposes of sampling, measuring and analysing milk meet the required operating and accuracy specifications as approved for the purpose from time to time by the Database Manager and published in the New Zealand Gazette or as described in Appendix I.
Use of Information
3.1 The Database Manager shall not be obliged to enter any data into the Database unless it is satisfied that the data or the manner in which it has been supplied complies with these Conditions.
3.2 The NZDB or the Database Manager, acting on its behalf, shall be entitled to use any data supplied by a Licence Holder in any manner at any time as it sees fit provided that such use complies with the Access Code.
Licensed Territory
4.0 Each Licence Holder shall offer its service to all farmers within the boundaries fixed by the NZDB and annexed to its herd testing licence. If no boundaries are defined, the district shall be the whole of New Zealand.
Variations
5.0 The NZDB may, from time to time, change or revoke these Conditions or part of them provided that 60 days' written notice of such changes or revocation has been given to each Licence Holder. Any revocation will be subject to clause 6 of these Conditons.
Cancellation
6.0 The NZDB may at any time cancel any herd testing licence if:
(a) the Licence Holder fails to remedy, within 30 days of having received a written notice requesting it to remedy, any non-compliance with the general intent of, or any default on any of its specific obligations under, these Conditions, including a failure to comply with any requirement in any Appendix; or
(b) after having given the Licence Holder 30 days' notice to answer any allegations, the NZDB is of the opinion that any claim made or implied by the Licence Holder about the value or quality of the information is either false or materially misleading.
Dispute Resolution
7.1 In the event of any dispute or difference arising between the Licence Holder, the NZDB or the Database Manager as to any matter concerning herd testing, either from these Conditions or otherwise, the parties to the dispute or difference shall in the first instance use their best efforts to resolve their dispute or difference by negotiation, but if the dispute or difference is not resolved within 7 days they shall refer it to the Dairy Herd Improvement Tribunal ("Tribunal") which may then either refer it to conciliation or decide the issue in accordance with its own procedures as a submission to arbitration under the Arbitration Act 1908 and its amendments.
7.2 If the Tribunal refers any dispute or difference to conciliation and that process is terminated without agreement having been reached, then the Tribunal shall decide the issue by arbitration as described in the preceding paragraph.
7.3 Pending a reference to the Tribunal and its decision being made known, the Licence Holder shall at the option of the NZDB continue to perform all its obligations under these Conditions without prejudice.
7.4 The Tribunal's decision, whether as a result of the conciliation or the arbitration procedure, shall be final and binding on all parties.
Definitions
Unless the context otherwise requires:
"Access Code":
means the code developed by the Dairy Herd Improvement Tribunal to govern that Tribunal and the conditions of access to the National Dairy Herd Improvement Database.
"Appendix" or "Appendices":
means the appendices relating to record formats, technical specifications or to other aspects of herd testing activities, annexed to and forming part of these Conditions.
"AB code identification":
means for every animal identified by this method the unique code issued by the Database Manager for identification of bull semen used in New Zealand.
"birth details":
means in each herd for each calf born at a calving, the cow number and if known the birth identification of the dam, together with sequence number, sex, fate, and if known birth identification, sire (AB code identification, or herdbook identification, or birth identification), and if recorded for the calf a comment code.
"birth identification":
means for each animal identified by this method a participant identification, year digits and sequence number.
"calving details":
means in each herd for every cow calving, the cow number and if known the birth identification of the cow, together with the date, number born, and if known, the assistance given.
"conciliation":
means the following procedure whereby the Tribunal refers a dispute or difference to a conciliator. In the event of a referral to conciliation under clause 7 of these Conditions, the conciliator shall forthwith assist the parties in an independent and impartial manner to reconcile their views on the dispute or difference to reach an amicable settlement or solution.
If they are unable to reach such an agreement or solution, the conciliator may formulate the terms of its determination or proposal for a settlement or solution. Such determination or proposal shall be binding on both parties unless within 5 days one party notifies the other that it rejects the conciliator's determination or proposal.
The conciliation procedure shall be deemed to have terminated:
(i) by the signing of a settlement agreement by the parties; or
(ii) by a written declaration of one party to the other and to the conciliator that the conciliation is terminated; or
(iii) by a written declaration by the conciliator to the parties that further efforts at conciliation are no longer justified; or
(iv) by the parties not objecting to the conciliator's determination or proposal within 5 days.
"Dairy Herd Improvement Tribunal":
means the tribunal established by the New Zealand Dairy Board on the recommendation of the Macdonald Committee Report 1992 to develop, among other things, guidelines, and to mediate on any issues, relating to access to the Database.
"data"
means any data, information or records, whether in electronic or manual form, which is obtained or provided pursuant to either a herd testing licence or service.
"Database Manager":
means the entity appointed by the New Zealand Dairy Board to operate and manage the National Dairy Herd Improvement Database.
"farm and herd identification":
means for a herd the map reference, herd number, and participant identification of the herd owner. These will be issued by the Database Manager for each herd each season.
"herdbook identification":
means (where applicable) for every animal identified by this method the Breed Society, sex and herdbook number.
"herd testing":
means the operation of testing milch cows in any two or more herds the property of different persons for the purpose of recording the milk production, milk composition and milk quality of individual cows within those herds in respect of milk volume and milk solids or characteristics, or any of them.
"lactation identification":
means for each herd for every cow with a lactation the test number of the animal together with calving date, condition at calving if known, the drying off date at the end of the lactation if recorded.
"Licence Holder":
means those persons or entities who have been granted a herd testing licence by the New Zealand Dairy Board, pursuant to the Herd Testing Regulations 1958.
"LIA identification":
means (where applicable) for each animal identified by this method a region number, herd number, year number, and sequence number.
"location identification":
means the cow number (or birth identification) of the animal together with the map reference, herd number, date in and, if the animal is no longer at this location, the date out, fate and cause code.
"mating detail"
means for each location the cow number or birth identification of the animal together with the following details for each recorded mating:
- either for single matings:
- date of mating, mating type, and
- if the mating is by artificial insemination, the AB code of the semen, participant code of the inseminator and, if known, the semen batch number, or
- if the mating is natural, the birth identification, or herdbook number, or AB code of the bull.
- or for animals run with a bull:
- date bull starts to run with animal, and
- birth identification, or herdbook identification of the bull, and
- date bull stops running with the animal.
"participant identification":
means for every legal entity involved in herd ownership in New Zealand, the unique participant code issued by the Database Manager.
"RDIPM":
means the record of details of identification, production and mating being a schedule, provided on electronic media of a type agreed from time to time with the Database Manager, with the following information recorded:
- farm and herd identifications,
- location identifications,
- birth identifications,
- calving details,
- birth details,
- lactation details,
- test day production details, and
- mating details.
Detailed formats, default values and codes are those approved for the purpose from time to time by the Database Manager and published in the New Zealand Gazette or as described in Appendix II.
"season":
means the period of 12 months ending with the
31st day of May in any year.
"test day production detail":
means for each herd the cow number of the animal together with the following details for each test:
- the date of test, abnormal code, and
- the milk volume for each milking carried out over the period of the test, and a calculated
24-hour milk volume equivalent, and
- based on a representative sample of the 24-hour milk production, the fat %, protein % and the somatic cell concentration, and/or
- any other characteristics of milk that may have been determined or be required.

APPENDIX I
TECHNICAL SPECIFICATIONS
The following specifications shall generally be required to be met for equipment to be considered for approval for use and inclusion to the schedule of approved equipment.
1. Milk Meters
Target Accuracy for Total Yield (in litres to one decimal point) for each animal shall be:
When herd test determinations are carried out less frequently than at every milking:
95% of milk yield measurements to be within ± 7.5%
99% of milk yield measurements to be within ± 10%
The first requirement has been interpreted as ± 7.5% where the true volume is 4.0 litres or more, and ± 300 grams where the true volume is less than 4.0 litres.
When herd test determinations are carried out at every milking
95% of milk yield measurements to be within ± 15%
99% of milk yield measurements to be within ± 20%
The first requirement has been interpreted as ± 15% where the true volume is 4.0 litres or more, and ± 600 grams where the true volume is less than 4.0 litres.
The target accuracy shall be maintained under the following conditions:
(i) flow rates between 0.5 litres/min and 9.0 litres/min, that exist for at least two minutes.
(ii) air pipeline vacuum levels between 36 and 56 kPa.
(iii) air admission rates between 4 and 12 litres/min, with a milk flow rate of 3 litres/min and air pipeline vacuum level of 50 kPa.
(iv) meter tilt of ± 5 degrees in forward, back, left and right directions, with a milk flow of 3 litres/min.
(v) the meter should perform to requirement on all types of installations when fitted in accordance with the manufacturer's instructions.
Yield Range
The measuring range for total yield shall not be less than
0-20 litres.
Hygiene Requirements
Surfaces of the meter which come in to contact with milk and wash water/chemicals shall be of materials which conform with the requirements of MAFQAL hygiene specifications.
The materials used for the meter shall be capable of repeatedly sustaining a continuous temperature of
95 degrees C for a period of 3 minutes, without affecting accuracy during subsequent milkings or causing visible deterioration of materials.
2. Component Sampling Accuracy
Target accuracy for subsample measurement shall be:
(i) within ± 0.1% for milkfat and/or protein units of the reference sample for 95% of all measurements.
(ii) within ± 0.2% milkfat and/or protein units of the reference sample for 99% of all measurements.
(iii) subsampler bias less than ± 0.1% for milkfat and/or protein units compared with the reference sample.
(iv) standard deviation for subsampler errors less than 0.05% units.
