Pursuant to the Public Works Act 1981 and to a delegation from the Minister for Land Information, Kerry McPhail, Land Information New Zealand:

  1. pursuant to section 20, and an agreement to that effect having been entered into, declares the land described in the First Schedule to this notice to be acquired for road and shall vest in the Crown;
  2. pursuant to section 114, declares the land described in the First Schedule to be road and shall remain vested in the Crown; and
  3. pursuant to sections 20 and 28, declares that an agreement to that effect having been entered into, the easement in gross described in the Second Schedule is acquired upon the terms and conditions set out in the Third Schedule to this notice and shall vest in the Crown

on the date of publication hereof in the New Zealand Gazette.

Second Schedule

Easement Acquired

An easement in gross for a right of way for access over the land marked A on SO 625761 (part Record of Title SL5A/439).

Third Schedule

Right of Way Easement Terms

Unless otherwise provided below, the rights and powers implied in specified clauses of easement are those prescribed by the Land Transfer Regulations 2018 and/or Schedule 5 of the Property Law Act 2007.

The implied rights and powers are the provisions set out below:

  1. The grantor grants to the grantee the use of, and maintenance responsibilities for, that part of the easement area shown marked A on SO 625761.
  2. The NZ Transport Agency (on whom this Easement Instrument is intended to confer a benefit and be enforceable accordingly for the purposes of the Contract and Commercial Law Act 2017) may exercise any of the grantee’s rights under this easement instrument.
