This notice is made under section 22(1)(b) of the Marine Mammals Protection Act 1978 by the Minister of Conservation.

Notice

1. Title

This notice is the Marine Mammals Protection (Te Pēwhairangi (Bay of Islands) Marine Mammal Sanctuary) Amendment Notice 2026.

2. Commencement

This notice comes into force on Saturday, 4 July 2026.

3. Principal Notice

This notice amends the Marine Mammals Protection (Te Pēwhairangi (Bay of Islands) Marine Mammal Sanctuary) Notice, published in the New Zealand Gazette, 17 November 2021, Notice No. 2021‑go4919.

4. Marine Mammal Safe Zones Removed

(1) Clause 3 is amended by revoking the definition of marine mammal safe zone.

(2) Clauses 4(3) to 4(6) are revoked.

(3) In clauses 5(1) and 5(2) the words “including marine mammal safe zones” are omitted.

(4) Clause 5(3) is revoked.

(5) Schedule 1A is revoked.

(6) Schedule 2 is revoked and Schedule 1 set out in this notice is substituted for Schedule 2 of the principal notice.

5. Commercial Permit Holders

Clause 5(5) is replaced with:

“(5) Subclause (2) does not apply to a person in charge of a vessel to the extent that the vessel is operating in accordance with a commercial permit issued under the Marine Mammals Protection Act 1978.”
