Notice of Application for Approval of a Scheme Under Part 3 of the Charitable Trusts Act 1957 (“Act”)

The board of trustees of the HEART LUNG FOUNDATION (formerly GREEN LANE RESEARCH AND EDUCATIONAL FUND BOARD and GREEN LANE HOSPITAL RESEARCH AND EDUCATIONAL FUND BOARD) (“Trust”) has applied to the Auckland High Court for approval of a scheme (“Scheme”). The Scheme proposes to adopt a new trust deed to achieve the following:

  1. Ensure that the board can support the medical education of all health professionals working in the medical specialisations which the Trust was intended to benefit, notwithstanding that such services are now provided at Auckland City Hospital instead of the now disestablished Green Lane Hospital.
  2. Allow the board to consider applications for research grants or funding on the merits and substance of the application itself without being limited by geographic region of the applicant’s residence or workplace.
  3. Allow the Trust to support a greater number of medical research projects from a wider pool of candidates across New Zealand.
  4. Provide the trustees with greater certainty about the scope and exercise of their powers, discretions, and duties in relation to the Trust.
  5. Enable the Trust to adapt to and conduct the affairs and administration of the Trust in accordance with modern practices that have arisen from the changes in society, technology, and law over time.

Copies of the Scheme, the proposed trust deed, and the Attorney-General’s report may be reviewed at the office of the Registrar of the Auckland High Court, or at the office of TGT Legal, Level 10, 55 Shortland Street, Auckland.

This matter will be heard at the Auckland High Court on 17 June 2026 at 11.45am.

Any person desiring to oppose the Scheme must, not less than seven clear days before the date proposed for the hearing of the application by the court, give written notice of their intention to oppose the Scheme to:

  • the Registrar of the Auckland High Court;
  • the trustees (via their solicitors at TGT Legal, PO Box 4039, Shortland Street, Auckland); and
  • the Attorney-General (via the Crown Law office, PO Box 2858, Wellington 6011).
