The Commerce Commission (“Commission”) gives public notice that it has commenced an investigation under clause 1(5) of Schedule 3 of the Telecommunications Act 2001 (“Act”).

The purpose of the investigation is to consider whether Mobile co-location services should be omitted from Schedule 1 of the Act under section 66(1)(b).

On 24 February 2026, the Commission decided under clause 1(3) of Schedule 3 of the Act that there are reasonable grounds for commencing the investigation. The Commission’s final decision paper is available on the Commission’s website at: https://www.comcom.govt.nz/regulated-industries/telecommunications/projects/review-of-co-location-on-cellular-mobile-transmission-sites/.

This notice is published in accordance with clause 1(6) of Schedule 3 of the Act, which requires the Commission to give public notice when commencing an investigation under clause 1.
