Notice of Exemption under the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999

Pursuant to Regulation 5 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999 (“PECPR Regulations”), I, Christopher John Thornborough, in exercise of powers delegated to me by WorkSafe New Zealand, hereby give notice that an exemption is granted to Worley New Zealand Ltd from those duties of the PECPR Regulations, which require pressure equipment to be design verified by a design verifier employed or engaged by a recognised inspection body.

This exemption applies only to pressure piping with AS 4343 Hazard Levels C, D, and E. This exemption is subject to the following conditions:

  1. Worley New Zealand Ltd shall retain its ISO/IEC 17020 accreditation and its quality management system’s ISO 9001 accreditation.
  2. Worley New Zealand Ltd shall ensure that WorkSafe are provided and maintained with a current copy of its ISO/IEC 17020 and ISO 9001 accreditation certificates and scopes at all times. Any changes to either scope of accreditation that may affect this exemption are considered to be significant changes that must be notified to WorkSafe as soon as the changes take effect.
  3. This exemption is limited to pressure piping designed by Worley New Zealand Ltd only and does not include pressure vessels and boilers.
  4. Worley New Zealand Ltd’s terminology of “Piping Conformity Assessment” is considered equivalent to the PECPR Regulations’ terminology of “Design Verification” and is only to be used in line with this exemption to differentiate from their Design Verification activities that are not covered by this exemption.
  5. Worley New Zealand Ltd “Piping Conformity Assessment” must be carried out by suitably qualified personnel employed, in accordance with the application’s submission documentation, in one of the following roles:
    1. Principal Engineer,
    2. Senior Engineer,
    3. Specialist Engineer.
  6. Worley New Zealand Ltd “Piping Conformity Assessors” must not have participated in the design of the item under “Piping Conformity Assessment”.
  7. “Piping Conformity Assessment” work must be performed and documented in accordance with the requirements of the relevant standards, the Approved Code of Practice for Pressure Equipment (Excluding Boilers), and Worley New Zealand Ltd’s quality management system.
  8. Certificates of “Piping Conformity Assessment” shall contain all requirements of PECPR regulation 31, except:
    1. 31(1)(c) in which the name of the inspection body is to be replaced by the words “In-house by Worley New Zealand Ltd under exemption”; and
    2. 31(2)(b).
  9. Copies of all “Piping Conformity Assessment” documentation must be given to the equipment owner and be made available for perusal by the recognised inspection body responsible for certifying the equipment for service.
  10. This exemption shall remain in force for a period of five years, provided all conditions continue to be satisfied, and unless cancelled in writing. Application for continued exemption will be required on or before 3 March 2031.
