Advertisement of Application for Order Take notice that on the 2nd day of December 1998, an application for an order under section 174 of the Companies Act 1993, in respect of Pacific Development & Investment Corporation was filed in the High Court at Auckland. The order sought is an order: (a) Requiring the defendant company or its directors to acquire the plaintiff's shares and those of any other minority shareholders who support the making of this order; and (b) Requiring the defendant company or its directors to pay compensation to the plaintiff and any minority shareholders who support the making of this order; and (c) Regulating the future conduct of the defendant company's affairs; and (d) Altering and adding to the defendant company's constitution; and (e) Directing the rectification of the records of the defendant company; and (f) Setting aside actions taken by the defendant company or the board in breach of the Companies Act 1993, and the constitution of the company.
