Sewerage Easement in Gross Acquired for a Public School in Whangarei District Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that, an agreement to that effect having been entered into, a sewerage easement in gross over the land described in the First Schedule to this notice (the subject land), subject to the terms and conditions set out in the Second Schedule to this notice (terms and conditions), is acquired for a public school and shall vest in the Crown on the date of publication in the New Zealand Gazette. First Schedule North Auckland Land District The Subject Land Part Allotment 11, Parish of Maungakaramea; marked ``A'' on S.O. Plan 56409. (Part certificate of title 2D/168). Second Schedule Terms and Conditions (1) The sewerage easement herein acquired shall be subject to the implied rights and obligations as set out in the Seventh Schedule to the Land Transfer Act 1952, except as varied herein. (2) All costs and responsibilities for the maintenance and repair of the sewer line shall be borne solely by the grantee. (3) The grantee may at any time on giving written notice in that behalf, surrender and extinguish the said easement by memorandum of transfer or by declaration published in the New Zealand Gazette, pursuant to section 42 (4) (a) of the Public Works Act 1981, and in doing so may enter by her servants, agents, engineers and workers onto the subject land with or without any necessary vehicles, implements, tools and material of any kind for the purpose of uplifting and removing the said sewer pipeline and restoring the surface of the subject land as nearly as possible to its former condition.
