The Wilson Home Trust Public Notice of Application to Modify Trust Pursuant to Section 36 of the Charitable Trusts Act 1957 Pursuant to Part III of the Charitable Trusts Act 1957, public notice is hereby given that application has been lodged in the High Court at Auckland under No. M. 1325/99 to vary the terms of the charitable trust called Wilson Home for Crippled Children. The trust has now been in operation for 62 years. It established an institution on the Lake Road site (``the site''), to provide residential care for crippled children. The following particulars of the new scheme: (a) The name of the varied trust shall be ``The Wilson Home Trust''. (b) Beneficiaries under the varied trust will be children 21 years of age or younger suffering disabilities living within the qualifying area (essentially the northern half of the North Island). Families of disabled children are to be included as beneficiaries also. These changes broaden the group of beneficiaries. (c) The types of assistance the varied trust can provide are to be widened to include services on and off the site, including assistance, education, training, residential accommodation, and co-operation with other service providers. (d) The varied trust authorises new centres to be purchased/developed within the qualifying area. It empowers subdivision and sale of Lot 1 and Lot 3 on a plan (``the plan'') of the site forming part of the new scheme. Any sale proceeds from those two lots form part of the trust. The trustees have undertaken to descendants of the original settler not to undertake any such sales except to fund or part fund such new centres. (e) The varied trust shall have no power to sell Lot 2 on the plan (being the central part of the site on which the original Wilson homestead and chapel are situated). Under section 37 of the Charitable Trusts Act, any person desiring to oppose the scheme shall not be less than 7 clear days before the date proposed for the hearing of the application by the High Court, give written notice of his intention to oppose the scheme to the Registrar, High Court and to Waitemata Health Limited and to the Attorney-General. The date proposed for the hearing by the Court is in the week beginning on the 1st day of November 1999, and will be fixed at a Court callover at 9.00 a.m. on the 27th day of October 1999. D. L.
