Summary of Exemptions Granted by the Director of Civil Aviation Pursuant to section 37 of the Civil Aviation Act 1990, notification is hereby given of a summary of exemptions as set out in the Schedule hereto, granted by the Director of Civil Aviation. Schedule 99/EXE/95 CAR 91.511 (b) On 8 December 1999. To Ansett New Zealand Limited. From the requirement that each powered aircraft with an airworthiness certificate operated under VFR by night shall have a means of indicating rate of turn and slip, only in respect to Non-EFIS equipped BAe 146 aircraft registrations ZK-NZF, ZK-NZG, ZK-NZH, ZK-NZI, ZK-NZJ. 0/EXE/15 CAR 139.5 (a) On 13 December 1999. To Gisborne District Council from the requirement that no person shall operate an aerodrome serving any aeroplane having a certified seating capacity of more than 30 passengers that is engaged in regular air transport operations except under the authority of, and in accordance with the provisions of, an aerodrome operating certificate issued for that aerodrome under Part 139, only with respect to Gisborne Aerodrome. This exemption shall remain in effect from 18 December 1999 to 9 January 2000 inclusive. 0/EXE/30 CAR 121.71 (f) & 139.305(5) To 13 December 1999. To Mount Cook Airline Ltd. From the requirements in (a) Civil Aviation Rule 121.71(f)(1), that each aerodrome to be used by an aeroplane that has a certificated seating capacity of more than 30 passengers and is engaged on a regular air transport passenger service, shall be an aerodrome that is associated with a Part 139 certificate; and (b) Civil Aviation Rule 139.305(5), that no person operating an aeroplane engaged on an air transport operation shall use any place for the purpose of landing at or taking off from unless, if the aeroplane has a certified seating capacity of more than 30 passengers and is engaged on a scheduled flight, the place is certificated as an aerodrome under Part 139; Only with respect to Gisborne Aerodrome. This exemption shall remain in effect from 18 December 1999 to 9 January 2000 inclusive. 0/EXE/35 CAR 139.305 (5) & 121.71 (f) On 13 December 1999. To Air Nelson Limited from the requirement in (a) Civil Aviation Rule 121.71(f)(1) that each aerodrome to be used by an aeroplane that has a certificated seating capacity of more than 30 passengers and is engaged on a regular air transport passenger service, shall be an aerodrome that is associated with a Part 139 certificate; and (b) Civil Aviation Rule 139.305(5), that no person operating an aeroplane engaged on an air transport operation shall use any place for the purpose of landing at or taking off from unless, if the aeroplane has a certified seating capacity of more than 30 passengers and is engaged on a scheduled flight, the place is certificated as an aerodrome under Part 139; Only with respect to Gisborne Aerodrome. This exemption shall remain in effect from 18 December 1999 to 9 January 2000 inclusive. 0/EXE/37 CAR 61.801(a)(3) & 61.801(a)(4) On 8 December 1999. To each person seeking an instrument rating. From the requirement in Civil Aviation Rule (a) 61.801(a)(3) that the ground training required for the issue of an instrument rating (A) or (H) be conducted by an organisation certificated under Part 141 to conduct that ground training; and (b) 61.801(a)(4) that the flight training required for the issue of an instrument rating (A) or (H) be conducted by an organisation certificated under Part 141 to conduct that flight training. The exemption shall remain in effect: (1) until the Civil Aviation Rules are amended to require all training necessary for the issue of ATPL, CPL, instrument rating, instructor rating and heavy type ratings to be conducted by organisation holding aviation documents issued by the Director; or (2) unless withdrawn in writing by the Director.
