Makaro Scientific Reserve Bylaws Pursuant to section 106 (3) of the Reserves Act 1977 (called the Act) the Minister of Conservation makes the following bylaws for the control and administration of the Makaro Scientific Reserve as described in the Schedule (called the reserve). 1. Right of Entry 1.1 Subject to the provisions of the Act and these bylaws the public may enter and remain on the reserve on the following conditions: (a) entry (and remaining on the reserve) is to be between the hours of 7.00 a.m. to 30 minutes after sunset of the same day, any day of the week; (b) apart from the area adjacent to the foreshore which is signposted to indicate where smoking is permitted, persons entering are not to use within the reserve any tobacco product, fire lighting equipment (including matches and lighters) or any utensil utilising fire or generating heat; 1.2 (a) If in the opinion of the Conservator, Wellington Conservancy, Department of Conservation (called the Conservator) there is a temporary risk to the environment, public safety, the safety of departmental staff whether that risk arises from natural events such as earthquake, fire or the risk of fire, or other causes then the Conservator may close the reserve or any part thereof to the public. When such closure occurs the Conservator shall place a sign on the reserve and where practicable will give public notice of such closure. (b) The Conservator may also close the reserve or any part thereof for administrative or reserve management purposes. The Conservator shall signpost such closed areas. 1.3 Entry and exit in contravention of 1.1 and 1.2 is prohibited except in an emergency situation or written authorisation is obtained from the Conservator. 2. Fires 2.1 Apart from the lighting of a gas barbecue in the area identified for smoking in bylaw 1.1 (b) no person shall light any fire on the reserve. 3. Tents and other structures 3.1 No person may erect any tent or other structure on the reserve without the prior written consent of the Conservator and then only at such location, duration, dimension and other in accordance with any other condition stated in the consent. 4. Animals and Plants 4.1 No person shall bring any animal into the reserve nor allow any animal in that person's custody or control to be within the reserve unless authorised in writing by the Conservator. 4.2 Any person authorised by the Conservator (either generally or in any particular case) may seize, detain or destroy any animal found within the reserve in breach of bylaw 4.1. 4.3 No person shall bring into the reserve nor have in that person's possession while on the reserve any tree, shrub or plant unless authorised in writing by the Conservator. 5. Misbehaviour 5.1 Within the reserve no person shall wilfully obstruct, disturb or interfere with any person in the use or enjoyment of the reserve or use foul, abusive, indecent or obscene language, or be intoxicated, noisy, or riotous or in any way misbehave. 5.2 Where any person breaches bylaw 5.1 that person shall commit a further offence if that person does not leave the reserve when so requested by an employee of the Department of Conservation. 6. Radios and Musical Instruments 6.1 No person shall if forbidden by an employee of the Department of Conservation use or play any radio, tape recorder, musical instrument or other device which disturbs other visitors in the reserve. 7. Offences 7.1 Every person who commits a breach of these bylaws commits an offence and is liable accordingly to the penalty prescribed in section 104 of the Act. Thus by way of example offences under the Litter Act, Civil Aviation Regulations, section 94 of the Reserves Act, continue to apply.
