Notice of Default Under Mortgage In the matter of section 92 (1) of the Property Law Act 1952, and in the matter of memorandum of mortgage No. 786630/3 over the land comprised and described in certificate of title 26K/113 (Canterbury Registry). To: Wilfred Francis David Bisset, 11 Davidson Street, Ashburton. D e f a u l t Westpac Banking Corporation being the mortgagee under the above-mentioned memorandum of mortgage hereby gives you notice that you are in default under the mortgage as follows: You have failed to pay upon the demand as required by the mortgage and specified in notices of demand dated 24 August 1998 the moneys secured by the mortgage and there is due and owing to the mortgagee as at 10 September 1998 the sum of $1,157,568.20 made up as follows: $ $ Bisset Engineering NZ Limited Overdraft 270,728.03 Interest accrued 30,970.86 Bank charges 135.57 (Interest accrues at 11.0 percent daily accural $81.59) Term loan 309,575.95 Interest accrued 6,014.53 (Interest accrues at 10.0 percent daily accural $84.42) 617,424.94 Rotowiper International Limited Overdraft 505,495.88 Interest accrued 34,141.93 Bank charges 505.50 (Interest accrues at 23.2 percent daily accural $321.30) 540,143.31 TOTAL $1,157,568.20 R e m e d y You are hereby required to remedy the said default: (a) By paying to the mortgagee the sum of $1,157.568.20. (b) By paying to the mortgagee interest on the sum of $270,728.03 at the rate of 11.0 percent per annum being $81.59 per day from 10 September 1998. (c) By paying to the mortgagee interest on the sum of $309,575.95 at the rate of 11.0 percent per annum being $81.59 per day from 10 September 1998. (d) By paying to the mortgagee interest on the sum of $505,495.88 at the rate of 23.2 percent per annum being $321.30 per day from 10 September 1998. (e) By paying to the mortgagee the sum of $550 being the costs of this notice and incidental thereto. C o n s e q u e n c e s If you do not remedy each default before 20 October 1998, the mortgagee will have the right to sell the land described in the mortgage or to enter into possession of the land, and all other rights conferred on the mortgagee by the mortgage will immediately become exercisable (to the extent that they have not already) and all money secured by the mortgage will immediately become payable (to the extent that it has not already).
