Australia New Zealand Food Authority Variations to the Food Standards Code (Amendment No. 39) 1. Preamble The variations set forth in the Schedule below are variations to the Food Standards Code (hereinafter called ``the Code'') which was published by the National Health and Medical Research Council in the Commonwealth of Australia Gazette, No. P 27, on 27 August 1987, and which has been varied from time to time. The Schedule contains variations adopted by the Australia New Zealand Food Standards Council in April, May and June 1998. These variations are published pursuant to section 32 of the Australia New Zealand Food Authority Act 1991. 2. Citation These variations may be collectively known as Amendment No. 39 to the Code. 3. Commencement These variations commence on the date of publication of this New Zealand Gazette. Schedule 1 Standard A6 is varied by 1.1 omitting paragraph 7(c) and inserting ``Vanilla essence or essence of vanilla is a flavouring obtained by extraction of vanilla beans or dilution of vanilla oleoresin.''; and 1.2 deleting subparagraph 8 (2) (b) (ii). 2 Standard G1 is varied by inserting after subsubclause (1) (a) (ii) ``(iii) Edible fats and oils, other than olive oil, may contain colourings specified in paragraph (2) (a) of Standard A5, provided that the food must not contain more than 20 mg/kg of annatto extract.''. 3 The Food Standards Code is varied by deleting Standard I2. 4 Standard R1 is varied by 4.1 inserting after subclause (5) (a) ``(aa) A lactose free food for specific dietary use is a food for specific dietary use the special dietary value of which results from (i) the restriction of ingredients containing lactose, the removal of lactose from or the decomposition of lactose in one or more of the ingredients or in the food itself, or a combination of these methods; or (ii) the use of ingredients that do not contain any detectable lactose. Explanatory note: A food specifically formulated to satisfy the dietary needs of persons suffering from lactose intolerance may be made from ingredients that do not contain lactose and can claim to be lactose free (if it complies with all other relevant requirements)."; 4.2 inserting after subsubclause (5) (b) (ii) ``(iii) Lactose free food for specific dietary use shall not contain any detectable lactose.''; 4.3 inserting after subsubclause (5) (d) (ii) ``(iia) The label on or attached to a package containing a lactose free food for specific dietary use must include, in type of 3 mm, the statements `LACTOSE FREE (here insert the name of the food)' `FOOD FOR SPECIFIC DIETARY USE'.''; and 4.4 inserting in subsubclause (5) (d) (iii) after ``reduced lactose food for specific dietary use,'' ``or a lactose free food for specific dietary use,''.
