Notice of Application Pursuant to Section 33 of the Charitable Trusts Act 1957 by The Robert Gibson Methodist Trust Board a Duly Incorporated Charitable Trust Having its Registered Office at Hawera 1. The Robert Gibson Methodist Trust Board has filed an application pursuant to section 33 of the Charitable Trusts Act 1957 seeking the approval of the High Court of New Zealand to a scheme which seeks to extend the power of the trustees and vary the administration of the trust. 2. The scheme for which approval is sought, seeks to: 1. (a) Alter the mode of administering the trust by removing the cap ``maximum limit of $40,000.00'' imposed upon the trust in respect of its reserve fund established by the scheme adopted by the Supreme Court of New Zealand on 25 February 1965; and (b) Provide that the maximum amount that may be accumulated in the reserve fund is to be determined from time to time by the conference of the Methodist Church of New Zealand, following a recommendation from the trust board after consultation between the trust board and the board of administration of the church. This is on the proviso that the maximum amount fixed at any time may not thereafter be reduced, and that if the amount held in the reserve fund is less than the maximum amount that the trust board may pay into the reserve fund, up to 20 percent of the net annual income of the trust in any one year, provided that the amounts paid shall not exceed the said maximum amount. 2. The trust board also seeks an extension of its powers by varying the existing provisions of the Supreme Court scheme to enable bursaries to be paid to girls and to young women to attend Wesley College at Paerata. 3. Full details of the application and the scheme and a report by the Attorney-General regarding same, are open for inspection by the public without fee or charge at the High Court office in Robe Street, New Plymouth. 4. It is proposed that the application will be heard by the High Court at New Plymouth at 9.15 a.m. on Friday, the 28th day of February 1997. 5. Any person desiring to oppose the scheme is required to give written notice of his or her intention to do so to: (a) The Registrar of the High Court of New Zealand at New Plymouth, P.O. Box 446, New Plymouth. (b) The Trustees, care of Messrs Halliwells, Solicitors, P.O. Box 422, Hawera. (c) The Attorney-General, care of Crown Law Office, P.O. Box 5012, Wellington. 6. Any such notice to oppose must be received not less than 7 clear days before the date when it is proposed that the hearing will take place. Dated at Hawera this 20th day of December 1996.
