Notice of Application for Approval of a Scheme Under Part III of the Charitable Trusts Act 1957 The Charitable Trusts Act 1957 Notice is hereby given that the board of the Selwyn Foundation (a trust incorporated under the Charitable Trusts Act 1957) has filed in the office of the High Court at Auckland for approval of a scheme relating to a term of a trust in a property located at Hobbs Road, Whangaparaoa, created by the will of the late Nora Helena Benn. Under the will and the trust created in the property, the property owned by Nora Helena Benn, Hobbs Road, Whangaparaoa (more or less being Lot 1, Deposited Plan 10818, and being part allotment 6, Parish of Waiwera and being all the land comprised and described in certificate of title, Volume 272, folio 286 (North Auckland Registry)), was to be left to the foundation for the purposes of establishing on that land an old peoples home to be known as the Sunnybank Old Peoples Home. Under this scheme the Selwyn Foundation wishes to be able to sell the land bequeathed to it by Nora Helena Benn and to apply the proceeds of such sale for the establishment of a wing in a new resthome (or in the alternative the refurbishment of an existing resthome or wing) at its Selwyn Village at Pt. Chevalier, Auckland with the new or refurbished resthome wing to be known as the Benn Wing or the Sunnybank Wing. Copies of the scheme and the report of the Attorney-General thereon may be inspected free of charge at the office of the Registrar of the High Court at Auckland, or at the offices of the Selwyn Foundation, Selwyn Village, Target Street, Pt. Chevalier. The application has been set down for hearing in the High Court at Auckland on Tuesday, the 18th day of March 1997, at 10.30 a.m. Any person desiring to oppose the scheme is required to give written notice of his or her intention to do so at the Registrar of the High Court at Auckland and to the Selwyn Foundation and the Attorney-General (via the Crown Law Office, St Pauls Square, 45 Pipitea Street, Wellington (Attention: Tracy Lamb)), not less than 7 clear days before the above-mentioned date.
