Notice of Emergency Rule Under Sections 31 and 35 of the Civil Aviation Act 1990 Pursuant to section 35 (4) of the Civil Aviation Act 1990, I, Kevin William Ward, Director of Civil Aviation, hereby give notice that I have made, pursuant to section 31 of the Act, the following emergency rule: Ardmore Aerodrome Traffic (a) The operator of Ardmore Aerodrome shall, when that aerodrome is being used by aerodrome traffic during the period between 2230 hours UTC and 0530 hours UTC during New Zealand daylight time, or 2330 hours UTC and 0630 hours UTC during New Zealand standard time, which is 1130 to 1830 hours local time, ensure that an aerodrome flight information service or an aerodrome control service is provided at that aerodrome. (b) No pilot in command of an aircraft shall takeoff, land, or enter the aerodrome traffic circuit at Ardmore Aerodrome during the period between 2000 hours UTC during New Zealand daylight time, or 2100 hours UTC during New Zealand standard time, which is 0900 hours local time, and one hour before evening civil twilight unless (1) an aerodrome flight information service or an aerodrome control service is provided at that aerodrome; or (2) the pilot in command (i) broadcasts, on the unattended radio frequency, the aircraft's callsign, position, altitude, and that pilot's intentions; and (ii) activates, if the aircraft is so equipped, the aircraft's landing lights or anti-collision lights; and (iii) does not perform banner towing operations within the aerodrome traffic circuit; and (iv) does not use any runway other than the single runway and direction currently being used by other aerodrome traffic; and (v) has, when circuit training, a current instructor rating; and (vi) has, for all operations other than circuit training, a minimum qualification of a current private pilot licence issued by the Director of Civil Aviation. In accordance with section 35 of the Act, this emergency rule 1. Shall come into force immediately upon this notice unless otherwise notified in accordance with section 35 (4) of the Act; and 2. Shall continue in force for a period not exceeding 90 days and may be renewed by the Director for a period not exceeding 30 days and may be further renewed by the Minister for a further period not exceeding 180 days.
