Declaring Easements Acquired for Hydro Electric Power Generation in the City of Dunedin Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Crown Property Services, Land Information New Zealand, Dunedin, declares that, an agreement to that effect having been entered into, the right of way described in the First Schedule hereto, over the land described in the Second Schedule hereto, the right to convey water described in the Third Schedule hereto, over the land described in the Fourth Schedule hereto, and the right to convey electricity described in the Fifth Schedule hereto, over the land described in the Sixth Schedule hereto, are hereby acquired for hydro electric power generation and shall vest in Waipori Power Generation Limited on the 5th day of December 1996. First Schedule Otago Land District Dunedin City A right of way easement (in gross) as defined in paragraph 1 of the Seventh Schedule to the Land Transfer Act 1952. Second Schedule Otago Land District Dunedin City All that piece of land containing 5102 square metres, being part Section 61, Block VIII, Waipori Survey District; shown marked ``C'' on S.O. Plan 23519, lodged in the office of the Chief Surveyor at Dunedin. Third Schedule Otago Land District Dunedin City A right to convey water (in gross) as defined in paragraphs 2 and 5 of the Seventh Schedule to the Land Transfer Act 1952. Fifth Schedule Otago Land District Dunedin City Rights and Powers Attaching to Right to Convey Electricity (in Gross) The full, free, uninterrupted and unrestricted right, liberty and privilege for the acquiring authority from time to time and at all times: 1. To convey electric current and electricity by means of a transmission line or lines following the stipulated course across the land. 2. To erect and place, suspend, inspect, repair, maintain, renew and replace such pylons, poles and ancillary equipment and to suspend such lines from the said pylons, poles and ancillary equipment as shall be necessary to convey such electric current and electricity. 3. In order to construct or maintain the efficiency of any such transmission lines, pylons, poles and ancillary equipment for the acquiring authority its employees, agents and contractors with any tools, implements, machinery, vehicles or equipment of whatsoever nature necessary for the purpose to enter upon the land over which the right to convey electricity is acquired (or where only the position of the transmission lines is defined in the easement then upon such part of the land of the person from whom the right was acquired and by such route as is reasonable in the circumstances) and to remain there for any reasonable time for the purpose of erecting and placing, inspecting, repairing, maintaining, renewing and replacing such transmission lines, pylons, poles and ancillary equipment subject to the condition that as little disturbance as possible is caused to the said land and that the surface is restored as nearly as possible to its original condition and any other damage done by reason of such operation is repaired.
